Section 8.8. 24 The employee with the greater seniority shall have preferential rights regarding shift selection, vacation 25 periods, special assignments, promotions, assignment to new or open positions, and layoffs when ability 26 and performance are substantially equal with the junior employee or other applicant. Employees within 27 the general job classification have preferential rights over junior employees, non-classification 28 employees and outside applicants. If the District determines that the seniority rights should not govern 29 because the junior employee or other applicant possesses ability or performance substantially greater 30 than a senior employee or senior employees, the District shall set forth in writing to the employee or 31 employees and the Association President its reasons why the senior employee or employees have been 32 bypassed.

Section 8.8. 2.1 2 When the number of available para educator hours allocated to a building is reduced, the 3 assignment of hours within the building shall be based upon the following considerations: 4 the needs of student(s) being served, current or previous work with particular student(s), 5 the needs of the program, skills, training and experience of the staff members, scheduling 6 factors, and the ability to provide continuity of support. When two or more para educators 7 are substantially equal with regard to the above listed factors, the assignment of hours will 8 be allocated on the basis of seniority, provided the reduction in hours exceeds 15 minutes 9 or more per day. A partial loss of hours is not considered a “displacement,” layoff or 10 reduction-in-force under Section 8.10. 12 The application of this section may result in hours being reallocated from a less senior 13 employee to a more senior employee, but will not result in a less senior employee losing an 14 entire position. A “position” for purposes of this section is the total number of regular para 15 educator hours assigned to an employee.
Section 8.8. In the event an employee is on disability leave pursuant to Section 8.4, or leave of 9 absence pursuant to Section 8.7 due to a disability, such employee shall be returned to the previously 10 held position, or a comparable position subject to Article IX herein.
