Section 10.9.3. An employee shall forfeit rights to reemployment as provided in Section 10.9.1 if the employee 17 does not comply with the requirements of Section 10.9.2, or if the employee does not respond to 18 the offer of reemployment within fifteen (15) workdays.
Section 10.9.3. An employee laid off who rejects an offer of reemployment forfeits seniority; provided, that 3 such employee is offered a position substantially equal in wages, hours and benefits to that held 4 prior to layoff.

Section 10.9.3. 36 The District shall offer additional duty time that becomes available to employees within the 37 building in the same general job classification on a seniority basis, if the time fits into the 38 employee’s current schedule.
Section 10.9.3. It is understood that job qualifications referred to in 10.9.3 shall be the same minimum 33 qualifications required for application if that position were an open position. It is further understood that 34 the District and Association shall work to pre-identify and mutually agree on essential positions.* 36 *Essential positions are those positions for which replacement would create severe disruption to the 37 District operation and for which time to train a new employee is obviously not either practical or 38 reasonable due to immediate critical demands. 40 Section 10.10. Re-employment Rights. All bargaining unit employees who are not offered 41 employment in accordance with the procedures in Section 10.9. shall be terminated from employment. 42 Such terminated employees and employees accepting less than comparable positions shall be placed in a 43 Layoff Employment Pool for possible reemployment for a period of two (2) years. Layoff Employment 44 Pool personnel, based on their seniority, will be offered comparable positions for which they are 45 qualified* and which do not increase their previous pay grade level. If no such comparable open position 46 can be offered, then the employee(s) shall have the option of accepting employment offers in less than 47 comparable open position(s). This process will continue until the employment pool is depleted or there 48 are no candidates qualified in the pool for any particular open position. In addition to the above, Layoff 1 Employment Pool members shall retain bargaining unit rights for any other application for open KAEOP 5 *Any question/concern of adequate qualification shall be jointly addressed and determined ▇▇▇ ▇▇▇ ▇ ▇▇▇▇▇▇▇▇/▇▇▇▇▇ ▇▇▇▇▇▇▇ process with input from the effected Layoff Pool employee.
Section 10.9.3. 8 Para-Educators in positions that are highly skilled or require educational certification, 9 licensure, or accreditation to perform their position shall be exempt from being bumped by 10 employees that do not have the credentials.
Section 10.9.3. 37 An employee shall forfeit rights to reemployment as provided in Section 10.8, if the employee 38 does not accept the offer of reemployment within five (5) workdays and/or report for work 39 within eleven (11) workdays from date of offer.
