Safety Record. Part 3.29 of the Disclosure Schedule sets forth a complete and accurate list of (i) all reportable incidents under occupational safety and health laws that have occurred since January 1, 2001; (ii) the Seller’s EMR rates for the periods January 1, 2001 to the date hereof, and (iii) the Seller’s OSHA reportable incident rates for the years ended December 31, 2003 and December 31, 2002. Except as set forth in Part 3.29 or Part 3.13 of the Disclosure Schedule, during the past three (3) years, no significant accidents or injuries have occurred in the workplace involving the Seller or any of its employees, officers, consultants, directors or contractors.

Safety Record. This factor evaluates the offeror’s and proposed team member’s safety record to ascertain the Offerors commitment to safety by achieving:  An EMR value less than or equal to 1.00. Offerors with an exceptionally low EMR (i.e., less than 0.75) may be rated more favorably. Offerors with an EMR value of 1.25 or greater may be rated less favorably.  An RIR value less than or equal to 4.7. Offerors with an exceptionally low RIR (i.e., less than 3.3) may be rated more favorably. Offerors with an RIR value of 4.8 or greater may be rated less favorably.  A DART value less than or equal to 3.4. Offerors with an exceptionally low DART (i.e., less than 2.0) may be rated more favorably. Offerors with a DART value of 3.5 or greater may be rated less favorably.  Zero fatalities. Offerors with fatalities may be rated less favorably. Offerors that demonstrate that incidents, leading to exceedances of the criteria listed above, were unrelated to employer negligence or unsafe site planning or activities and/or have described sufficient corrective actions taken to improve their safety program may be rated more favorably. Offerors that describe initiatives in pursuit of proactively preventing fatalities, injuries, and illnesses through a system focused on: hazard prevention and control; worksite analysis; training; and management commitment and worker involvement may be rated more favorably. In addition, the Government may review any other sources of information in order validate the Offeror’s safety record. These may include, but are not limited to, a review of safety violations retrieved through the OSHA records database of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary /affiliate) identified in the offeror’s proposal and any other known sources not provided by the offeror.
