If an agreed Job Description is not achieved within eight working weeks of the anniversary date, then the Dispute Resolution process may be invoked. A teacher who is, from time to time, left in charge of a School in circumstances where the Principal (and Deputy Principal where applicable) is absent from the premises for a whole day or more and where there is no person with classification greater than or equal to 9 leadership points, shall be paid an allowance as specified in Schedule 1 for each day of higher duties. The allowance shall be paid from the first day of the absence. A day is defined as commencing at the start bell and concluding at the finish bell. This Clause 78 shall not operate to the exclusion of Clause 68 Higher Duties – Teachers.
Role Review. An ESO may request that consultation occur at a mutually agreed time between the employer and the employee to ensure that the duty statement is accurate and conforms with the classification levels as detailed in Appendix E (ESO) or Appendix F (IEO).
98.1 On application to the principal/employer, full-time ESOs may access approved professional development/training (including school based) of up to 5 days in a 2-year period. The allocation will apply on a pro-rata basis for a part-time ESO.
98.2 For the purposes of this clause only, a full-time ESO is deemed to be one who works at least a 27.5 hour week/40 weeks per year or 1100 hours per calendar year.
98.3 The cost of the training is to be met by the employer.
98.4 If professional development/training is required by the principal/employer on a day or part-day when the ESO is not normally working then the employee will be paid at the Additional Hours Loading applicable to their classification or provided with time off in lieu (at a mutually agreeable time) as the ESO elects. Where the employee elects to be paid, the minimum 2 hour payment will be disregarded.
98.5 Sub-clause 98.4 will not apply if the total number of days required to work in a week does not exceed the number normally worked in a week. However, an employer cannot require an employee to work a day in lieu of a public holiday.
98.6 At least 4 weeks notice must be provided to the ESO if sub-clause 98.4 is invoked by the employer.
99.1 The maximum number of ordinary hours of work is 37.5 hours per week or 150 hours in a 4 week period.
99.2 For an ESO employed in outdoor education the hours of work may be averaged over a period of up to 12 months.
99.3 The ordinary hours of work will be worked on no more than 5 days in any 7 days.
99.4 Except for security/caretaking, cooking, catering, housekeeping and laundry services ESO in the Services Stream, and outdoor education in the Curriculum Stream, the ordinary hours of work will be worked Monday to Friday.
99.5 The span of ordinary hours will be as follows:
a) between 8.00am and 6.00pm for Education Support Officers employed in the Curriculum Stream, Resources Stream, Administration Stream and Other Professionals Stream; b) between 6.30am and 6.30pm for Education Support Officers employed in the Extension Stream, and in the Early Childhood/OSHC Stream; c) between 6.00am and 6.00pm for Services Stream Education Support Officers (this includes cleaners except for cleaners who regularly are required to ...
Role Review. (a) On the first anniversary of appointment (and biennially thereafter), or at another mutually agreed time, consultation will occur between the School and the Lutheran School Officer to ensure that the job description is accurate and conforms to the classification levels set out in Schedule 4.
(b) If an agreed job description is not achieved within eight working weeks of the anniversary date, then the clause 7 - Dispute Resolution process may be invoked.

Clause 53. Classification Structure
53.1 The College, by reference to the criteria prescribed below and the employee’s prescribed duty statement, classify employees at the relevant grade and within one of the following sub classifications:
53.2 An employee who has duties consistently traversing more than one sub classification stream will be classified within that stream which describes the major and substantial part of the employee’s allocated duties.
53.3 Nothing contained in Clause 53 may be read or construed as limiting or affecting the right of the College reasonably to require an employee of any classification at any time, or temporarily, to perform duties appropriate to other sub classifications whether or not the duties are those normally attached to a higher or lower grade and sub classification or any other duties associated with the conduct or operation of the College.
53.4 Definition 1: Supervision
53.4.1 Close supervision: clear and detailed instructions are provided. Tasks are covered by standard procedures. Deviations from procedures or unfamiliar situations are referred to higher levels. Work is regularly checked.
53.4.2 Routine supervision: direction is provided on the tasks to be undertaken with some latitude to rearrange sequences and discriminate between established methods. Guidance on the approach to standard circumstances is provided in procedures, guidance on the approach to non-standard circumstances is provided by a supervisor. Checking is selective rather than constant.
53.4.3 General direction: direction is provided on the assignments to be undertaken, with the employee determining the appropriate use of established methods, tasks and sequences. There is some scope to determine an approach in the absence of established procedures or detailed instructions, but guidance is readily available. When performance is checked, it is on assignment completion.
53.4.4 Broad direction: direction is provided in terms of objectives which may require the planning of staff, time and material resources for their completion. Limited detailed guidance will be available and the development or modification of procedures by the employee may be required. Performance will be measure...
Role Review. If a School Assistant, or their line manager, believes the employee's role needs a review, they are entitled to request that consultation occur between the employer and the employee to ensure that the duty statement is accurate and conforms to the classification levels as detailed in Appendix E (Classification Structure for School Assistants). The employee's request should proceed via their line manager. The employer shall not unreasonably refuse to act upon such a request.
Role Review. The Union may request Vancity to conduct a review of a role, where a substantial change of duties can be demonstrated. Such request must be made in writing, detailing the duties and responsibilities that do not fall substantially within those contained in the job description. In the event that an agreement cannot be reached, the matter may be referred to arbitration as provided for in this collective agreement.

Parties may choose to adjust the role of the BCCOC or subcommittees after 5 years by consensus (the process for which will be described with particularity in the Charter). If after 10 years enough operational activity is present on the Broadway Corridor, and the BCCOC and subcommittee roles are substantially completed, ▇▇▇▇▇▇▇ may initiate a closeout of the committee and/or subcommittees and create an inclusion-centered operations body. To the extent the close-out in 10 years (should it occur) results in substantial cost savings, ▇▇▇▇▇▇▇ will discuss with the BCCOC and will consider in good faith the potential allocation of all or a portion of the anticipated cost savings to the Construction Equity Fund or other similar purposes.
