Road Work. 12.1 Employees regularly assigned to road repair work whose tour of duty is regular and who leave and return to home station daily (a boarding car to be considered a home station) shall be paid continuous time from the time of leaving the home station to the time they return, whether working, waiting or travelling, exclusive of the meal period as follows.
12.2 For all hours travelling, waiting, or for work performed during regular work hours, straight time shall be paid and overtime rates for work performed during overtime hours. If relieved from duty and permitted to go to bed for five hours or more, they will not be allowed pay for such hours. Where meals and lodging are not provided by the Company when away from home station, actual necessary expenses will be allowed. (See Schedule A, Page 88)
12.3 The starting time not to be earlier than 6 a.m. or later than 8 a.m.
12.4 Where two or more shifts are worked, the starting time will be regulated accordingly.
12.5 EXCEPTION - Where the schedule of trains interferes with the starting time an Agreement may be entered into by the Superintendent of the Department affected and the Local Chairperson affected.
12.6 When such employees do not return daily to their home station or boarding car, they will be paid for all overtime actually worked as per Rule 14.1 and 14.2 and in such cases where meals and lodging are not furnished by the Railway, employees will be paid actual expenses. If lodging is not available at point where work is performed, employees will be paid according to Rule 17 until they reach lodging, home station or boarding car.
12.7 Road repair employees sent out on the road will receive pay at straight time rates for waiting and travelling from time called until they reach the first point at which they have to work and will be compensated for any additional expenses they necessarily incur.
12.8 Employees sent out on road repair work under this Rule 12 on regularly assigned rest days shall be paid time and one-half for working, waiting and travelling with a minimum of eight (8) hours at time and one-half.
12.9 Employees sent out on a holiday which is the employee's regular rest day shall be governed by Rule 51.

Road Work. 8.1 Rules 8.1 through 8.8 are only applicable to the trades of Heavy Duty Mechanic and Electrician. At locations where Heavy Duty Mechanics or Electricians are required to protect emergency service and/or trouble calls, Mechanics shall be given an opportunity, by bulletin, to bid on the secondary assignment. There shall be a regular list and a spare list and secondary assignments will be awarded on the basis of seniority on the respective shift the secondary assignment will protect.
8.2 Employees regularly assigned to repair or maintenance positions who perform work away from their home seniority terminal, and who are not covered by Rules 6, 7 or 9, shall be paid under the provisions of this Rule 8.

Road Work. The Manager shall be responsible for the monitoring, inspection, maintenance, repair, replacement and further improvement of the Private Road (“Road Work”). The Road Work includes (a) the maintenance, repair and replacement of the surface and subsurface of the Private Road in a level and smooth condition (to the extent practical), evenly covered with the type of materials originally constructed thereon or such substitutes as will, in all respects, be equal to such materials in quality, appearance and durability; (b) such future improvements in the Private Road that may be reasonably necessary for the Private Road to provide safe and usable access from N. Benchmark Avenue to Parcels 2 and 3 in accordance with applicable law; and (c) such future private road improvements in the Private Road that may be approved by the Owners (e.g., gates, entrance signs and other similar items). All Road Work must be performed to an equal standard over the entire length of the Private Road and shall be performed in a manner which will leave the road accessible to vehicular traffic to and from Parcels 2 and 3 at all times. In addition to the Road Work set forth above, the Manager shall be responsible for plowing and snow removal of the Private Road within 4 hours of receiving more than 2 inches of snow. In the event a snowfall occurs outside of regular business hours and the snow accumulates to more than 2 inches, the Manager shall be responsible for plowing and snow removal of the Private Road at least 1 hour prior to the start of the Owners’ regular business hours. Manager shall be responsible for contacting the Owners each September for the purpose of ascertaining their business hours for the proceeding Winter.
