Responsibility for Data. Recipient is responsible from the Agreement Date for (1) the accuracy and completeness of the data submitted by Recipient in connection with the Services and (2) any errors in and with respect to data obtained from Service Provider because of any inaccurate or incomplete data submitted by Recipient to Service Provider.

Business days will be defined to be Monday through Friday, from 8:00 A.M. to 5:00 P.M. EST. Failure to report any discrepancies within the time prescribed in the previous sentences shall constitute a conclusive presumption that such reports are correct and accurate. JXX will provide safeguards determined at its discretion to ensure protection against destruction of records and Software by fire or other disasters, loss of data in transit or machine or human error, or unauthorized manipulation of data or reports insofar as can reasonably be expected using then current techniques and/or then current accepted business practices for storage and transfer of magnetic media.

It is the Subscriber's sole responsibility to take precautions against data loss. If the Company offers a backup service, it is stored at the same physical location as the primary Service unless otherwise stated. Any backup service offered is on a best-efforts basis only, and no guarantees nor warranties, either expressed or implied, regarding the safety, longevity or availability of the data stored on this server are offered. Any data uploaded to, and/or stored on, the backup service is done entirely at Subscriber's own risk.
Responsibility for Data. Employer is assumed to have all necessary agreements regarding the use of Employee Navigator in place and to the extent that a third party is managing Employer’s data in Employee Navigator on behalf of Employer it is understood that Infinisource will accept all data as is and will not be responsible for any errors that result from inaccurate or incomplete data.
