Replacement Documentation. Upon receipt of an affidavit of an officer of the Administrative Agent as to the loss, theft, destruction or mutilation of the Note or any other loan document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such Note or other loan document, the Borrower will issue, in lieu thereof, a replacement Note or other loan document in the same principal amount thereof and otherwise of like tenor.
Replacement Documentation. Upon receipt of an affidavit of an officer of Administrative Agent or any of the Lenders as to the loss, theft, destruction or mutilation of a Note or any other security document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, Borrower will issue, in lieu thereof, a replacement Note or other security document in the same principal amount thereof and otherwise of like tenor. In the event that Borrower issues such replacement Note or other security document, the Lender who is the payee on the lost, destroyed, mutilated or stolen Note or security document shall indemnify and hold harmless Borrower from any liability incurred by Borrower in connection with the lost, stolen, destroyed or mutilated Note or security document.
Replacement Documentation. Upon receipt of an affidavit of an officer of Lender as to the loss, theft, destruction or mutilation of a Note or any other security document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, Borrower will issue, in lieu thereof, a replacement Note or other security document in the same principal amount thereof and otherwise of like tenor. In the event that Borrower issues such replacement Note or other security document, Lender shall indemnify and hold harmless Borrower from any liability incurred by Borrower in connection with the lost, stolen, destroyed or mutilated Note or security document.

Upon receipt of an affidavit, reasonably acceptable to Borrower, of an officer of Administrative Agent or any of the Lenders as to the loss, theft, destruction or mutilation of a Notes or any other Loan Document which is not of public record, Borrower will issue, in lieu thereof, a replacement Notes or other Loan Document in the same principal amount thereof and otherwise of like tenor. In the event that Borrower issues such replacement Notes or other Loan Document, the Lender who is the payee on the lost, destroyed, mutilated or stolen Notes or Loan Document shall indemnify and hold harmless Borrower from any liability incurred by Borrower in connection with the lost, stolen, destroyed or mutilated Notes or Loan Document.
Replacement Documentation. Upon receipt of an affidavit of an officer of Agent as to the loss, theft, destruction or mutilation of this Agreement, any other Loan Document, or any other security document which is not of public record, or an affidavit from any Lender as to the occurrence of the same to such Lender’s Note, and customary (unsecured, unbonded) indemnification from the Agent or the Lender, as applicable, reasonably satisfactory to the Borrower, the Borrower will issue, in lieu thereof, a replacement Note, Agreement, Loan Document or other security document in the same principal amount thereof and otherwise of like tenor.
Replacement Documentation. Upon receipt of an affidavit of an officer of the First Union Lender as to the loss, theft, destruction or mutilation of the Loan Note or any other Security Document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such Loan Note or other Security Document, the Borrower will issue, in lieu thereof, a replacement Loan Note or other security document in the same principal amount and otherwise of like tenor upon receipt by the applicable MARC Entity of a suitable indemnity.
Replacement Documentation. Upon receipt of an affidavit of an officer of the Administrative Agent as to the loss, theft, destruction or mutilation of the Note or any other loan document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such Note or other loan document and, if such Note or other loan document is lost, stolen or destroyed and, accordingly, is not surrendered to Xxxxxxxx, the delivery of an indemnity from Administrative Agent or the applicable Lender in favor of Xxxxxxxx, the Borrower will issue, in lieu thereof, a replacement Note or other loan document in the same principal amount thereof and otherwise of like tenor.
Replacement Documentation. Upon receipt of an affidavit of an officer of Lender as to the loss, theft, destruction or mutilation hereof, the Note or the Lender Security Agreement, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation thereof, the Borrower will issue, in lieu thereof, a replacement thereof of like tenor.
Replacement Documentation. Upon receipt of an affidavit of an officer of Agent as to the loss, theft, destruction or mutilation of the NMLP Note or any other NMLP Security Document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such NMLP Note or other NMLP Security Document, NMLP will issue, in lieu thereof, a replacement NMLP Note or other security document in the same principal amount and otherwise of like tenor upon receipt by NMLP of a suitable indemnity.

Upon receipt of an affidavit of an officer of Agent as to the loss, theft, destruction or mutilation of the T-Two Note or any other T-Two Security Document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such T-Two Note or other T- Two Security Document, T-Two will issue, in lieu thereof, a replacement T-Two Note or other security document in the same principal amount and otherwise of like tenor upon receipt by T-Two of a suitable indemnity.
