Proportionate. It is proportionate to share the information as it is deemed that the identified purpose justifies infringing the data subject’s right to privacy and appropriate measures to meet the purpose are both fair and rational.

In judging whether it is appropriate to share such information the Police, and LCC – Troubled Families will examine whether the identified purpose infringes upon the subject’s right to privacy, the appropriate measures to meet the purpose are both fair and rational and also that the means used are no more than is necessary to accomplish the purpose.

With all its cognate variations shall mean the proportion in which the built-up-area of any single flat/unit would bear to the entire undivided built-up-areas of all the flats/units collectively for the time being in the building, PROVIDED THAT where it refers to the share of any rates and/or taxes relating to the common purposes and the common expenses then such share shall mean the proportions in which the total amount of such taxes rates or expenses as shall be paid equally by the co-owners and such share shall be treated as such rates and/or taxes and common expenses as are being separately levied, and the Proportionate Share of the “Said Land” under the First Schedule and in a proportion to the measuring area of a single flat or unit out of the total measuring area of the entire undivided covered areas of all the flats and the units collectively in the building constructed on the “Said Land” at the “Said Premises”.
Proportionate. Share: Tenant’s initial Proportionate Share is 4.35% based on the ratio that the Rentable Area of the Leased Premises (i.e., 7,401 square feet) bears to the Rentable Area of the Building (i.e., 170,173 square feet).
Proportionate with all its cognate variations shall mean such ratio as the Carpet Area of any Unit or Units is in relation to the Carpet Area of all the Units in the Building;

Proportionate. The amount and type of information that should be shared between the partners signed up to this agreement must always be proportionate and necessary, in order to achieve the purposes of this agreement. Partners recognise that if they comply with the DPA Principles, then any sharing they do under this agreement is likely to be compatible with the Human Rights Act and therefore not breach Article 8. The ECHR does not restrict information from being shared for safeguarding and welfare purposes, but does require that consideration is made regarding what is ‘reasonable’ in the circumstances. Disclosures must always be proportionate, necessary and relevant.
Proportionate. The amount and type of information shared will only be the minimum necessary to achieve the aim of this agreement. Information is always to be considered in terms of its relevance and proportionality in each set of circumstances, but it must always be remembered that the right to life is paramount and an absolute right. An activity appropriate and necessary in a democratic society – The police are obliged to do all that is reasonable to ensure the welfare of the most vulnerable of citizens and this is something that is necessary and appropriate in a democratic society. Other signatories to this agreement such as NHS bodies and Children’s Services also have similar obligations, which are necessary and appropriate in a democratic society. Schedule 2, Data Protection Act 2018 In addition to the legal criteria set out above, the information sharing arrangement must satisfy at least one condition in Schedule 2 of the Data Protection Act in relation to personal data. Schedule 2 is satisfied in the case of this agreement by condition 5(b) (the exercise of functions conferred under statute) as there is an implied gateway available for the sharing of information in these circumstances under S.11 Children Act 2004, which obliges the relevant agencies to ensure that its “functions are discharged having regard to the need to safeguard and promote the welfare of children”. Schedule 3, Data Protection Act 2018 If the information is “sensitive” (that is, where it relates to race, ethnic origin, political opinions, religion or belief system, membership of a trades union, physical/mental health or sexual life, the commission or alleged commission of any offence, proceedings relating to the offence) you must satisfy at least one condition in Schedule 3. Schedule 3 is satisfied in the case of this agreement by condition 7, “the processing is necessary for the exercise of any functions conferred on any person by or under an enactment” (i.e. as mentioned above, Children Act 2004). SECOND PRINCIPLE Lawfulness, fairness and transparency You must process personal data lawfully, fairly and in a transparent manner in relation to the data subject.
