Programmatic Agreement. Should the execution of an MOA be inappropriate given the similar nature of effects on historic properties, the inability to determine effects prior to approval of an Undertaking, or where other circumstances warrant, FEMA, shall consult with the SHPO, participating Tribes, the ACHP, if participating, and any other consulting parties to develop a Programmatic Agreement in accordance with 36 CFR § 800.14(b) and identify programmatic conditions or treatment measures to govern the resolution of potential or anticipated adverse effects from certain complex project situations for an Undertaking or for multiple but similar Undertakings by a single subgrantee.

Programmatic Agreement. 36. The Parties recognize and acknowledge the special role of the Cultural Resources Management Group ("CRMG") in overseeing the protection, enhancement and mitigation of cultural resources. The composition, procedures, and protocols for the CRMG are described in the Programmatic Agreement and Xxxxx Fork Heritage Resource Program ("CFHRP") attached hereto as Appendix R. The Parties agree that they will comply with the provisions of the CFHRP and that the TACs and other committees will consult with the CRMG on any PM&Es that are likely to directly or indirectly affect cultural properties and will advise the Management Committee of the comments of the CRMG related to cultural properties when submitting recommendations for PM&Es to that Committee. The CRMG may submit written comments to the Management Committee on PM&Es recommended to that Committee by the TACs at the time those recommendations are submitted to the Management Committee. Within one year of the effective date of this Agreement, the Management Committee shall adopt protocols for determining those PM&Es and related activities which are likely to directly or indirectly affect cultural properties. Programmatic Agreement. On April 29, 2019, the U.S. Army Corps of Engineers, St. Xxxx District and the Minnesota State Historic Preservation Office entered into a Programmatic Agreement regarding the issuance of a Lease to allow for the construction of a National Loon Center at the Cross Lake Recreation Area, Crow Wing County, Minnesota, attached hereto and made a part hereof as Exhibit C. The Lessee and Lessor agree to comply with all terms and conditions of said Programmatic Agreement and shall be binding upon the Lessee and Lessor.

The FMA is responsible for the development of a Historic Preservation Manual that will contain Design Standards for historic properties and new construction . The FMA is also tasked with the development of an Interpretive and Educational Programs Plan . The Commonwealth of Virginia is responsible for ensuring many things occur once they assume responsibility for the management of the property . These include provisions for conducting ongoing property evaluation and condition assess- ments; provisions for identifying and treating archeological resources; provi- sions for appropriate protective mechanisms in the event of sale transfer or lease of property; specifics for a continuing review process for future activities at Fort Monroe, i .e . the establishment of a FMHPO; and other responsibilities .
