Program Data. HydroCorp will generate and document the required program data for the Facility Types listed in the Scope of Services using the HydroCorp Software Data Management Program. Program Data shall remain property of the Utility; however, the HydroCorp Software Data Management program shall remain the property of HydroCorp and can be purchased for an additional fee. Data services will include: • Prioritize and schedule inspections • Notify users of inspections, backflow device installation and testing requirements if applicable • Monitor inspection compliance using the HydroCorp online software management program. (Note: WI Department of Safety & Professional Services (DSPS) manages backflow prevention assembly testing notification and compliance.) • Maintain program to comply with all DNR regulations

Program Data. GAF has, and shall have, all right, title, and interest in and to all Program Data (as defined below), and except for the limited license granted herein, nothing contained in this Agreement shall be construed to convey to you any right, title, or interest in or to the Program Data. Program Data. Subject to existing Federal and State privacy laws regarding Obagi Inc.’s patients (including compliance with HIPAA), as between Obagi Inc. and/or the Marketer on one hand and OMP on the other, and subject to Xxxxxxx 00, Xxxxx Inc. and/or the Marketer shall be the owner of all accounts, customer lists and other customer information and data (the “Program Data”) developed in connection with the Program; provided, however, that OMP shall have a perpetual, royalty-free, non-exclusive license to have access to and to utilize the Program Data.
Program Data. SHMC is the sole and exclusive owner of all data and information relating to Members and the Program, including, without limitation, the Member list, all Member enrollment and contact information, Member passwords, Member Numbers, and Points accounts, but excluding the Transaction Information and the Member Analytics Reports (collectively, “Program Data”), and LE has, and will have, no ownership interest of any kind whatsoever in the foregoing. For clarification, all data and information relating to Members and the Program that is collected by LE pursuant to this Agreement, including Program enrollment information (collectively, “LE-Collected Program Data”) shall be deemed Program Data and shall be solely and exclusively owned by SHMC. The LE-Collected Program Data will be delivered to SHMC in the format and with the frequency, and using the secure delivery methods, in effect as of the Effective Date. SHMC may revise the format, frequency, and methods related to the delivery of the LE-Collected Program Data from time to time upon 30-days’ advance written notice to LE, except that security related changes shall be made as soon as possible and without unreasonable delay. SHMC may use the Program Data to operate the Program and for all other purposes in accordance with its privacy policy and Applicable Law (including transfer to, and use by, third parties) without restriction. Except as authorized under this Agreement, LE may not use or disclose Program Data in any manner. Further, to the extent LE or its Affiliates maintain or store any Program Data that may have been received or may in the future be received from SHMC or any other source, including, without limitation, any database of Member information, LE agrees to promptly return or secure destruction of such Program Data in an expeditious manner in a manner consistent with Exhibit 5 upon SHMC’s request.
Program Data. The most critical element of a Cross-Connection Control Program is data integrity. Without accurate data, the Cross-Connection Control program will experience customer service, administrative, and reporting issues and also result in field survey inefficiencies.
Program Data. Recipient hereby provides MOD with a perpetual, non-exclusive, revocable, royalty-free license and authorization to aggregate and anonymize User Data and Program performance data (e.g., End User surveys, courses completed, course results, etc.) and utilize such aggregated or anonymized information and statistical usage data for purposes including, for example, evaluating the Program and reporting on Program performance (including, inter alia, to third party funders, when relevant).

Program Data. Program Participant acknowledges and agrees that AHA owns the Program Data (excluding Individually Identifiable Health Information and the Limited Data Sets, which Program Participant owns) and Program Materials, and that Program Participant shall not reproduce, distribute, create derivative works, display or present the Program Data or Program Materials other than in connection with treating or advising Program Participant’s patients, or for other internal business purposes allowed under this Agreement, without the prior written approval of AHA, which shall not be unreasonably withheld.
Program Data. Customer shall retain all right, title and interest in and to any information, data, study findings, or report content created by Sensys Gatso related specifically to the Program or its operation (“Program Data”). Customer grants to Sensys Gatso: (a) a non-exclusive, worldwide, royalty-free, fully paid up, sub licensable, non-transferrable right and license during the Term to copy, distribute, display and create derivative works of and use Program Data solely to perform the Services; and (b) a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully paid up, right and license to use Program Data solely in an aggregated, de-identified or anonymized format such that Customer, its personnel and violators are not identified, in order to evaluate and enhance Sensys Gatso’s systems and services. Sensys Gatso and its affiliates may identify Customer as an entity utilizing the Services and the System in its marketing materials, including but not limited to its website and proposals to perform the same or similar Services for others, without the prior written consent of Customer.
