Production Capacity. Supplier shall maintain sufficient production capacity as to be able to supply Products in accordance with any reasonable S&W forecasts and the Lead Times. Supplier shall notify S&W as soon as is reasonably possible of any inability by Supplier to produce and deliver Products in such quantities as are necessary to meet S&W’s anticipated volume requirements.
Production Capacity. The ASEAN Copper Fabrication Project (Philippines) shall have a capacity of 100,000 MTPY which includes 20,000 MTPY intended for non-ASEAN markets. The copper fabrication plant shall produce the following products: rods, bars and sections, tubes, plates and sheets, and wire rods.

However, to the extent Seller does not have sufficient capacity to meet Buyer's orders beyond forecast and minimum commitments, Seller will allocate capacity at the Salt Lake City facility pro-rata among Buyer and other customers, based on customer unit order volumes, and Buyer is under no obligation to approve the manufacture of Products at any other of Seller's locations if Buyer determines in its sole discretion that such location does not meet Buyer's business needs.

Production Capacity. Seller shall make available the necessary capacity to meet Issuing Parties' production requirements, as provided by Issuing Parties in Sections 2.A and 3. D. Buyer agrees to not unreasonably withhold approval of additional production facilities in the event of extraordinary demand.

Keurig warrants that during the warranty period provided for in Section 3.1.1, the Packaging Lines shall be capable of yielding Acceptable K-Cups to Standard at a minimum production rate capacity of 100 K-Cups per minute of run time, with a commercial tolerance of total rejects of less than 5% per production run provided the Packaging Lines are operated in accordance with the Operating Manual. Production run capacity shall be determined by analysis of no less than one (1) month’s data collected as per the form attached as Schedule 3.1.3 during a period when a Packaging Line was available for production, and labor, raw materials and utilities were available. In the event that Xxxxxxxx’x analysis of production capacity discloses a substandard performance rate or yield of Acceptable K-Cups to Standard, Xxxxxxxx shall notify Keurig that it is exercising its rights pursuant to Section 3.1.6 below. During the warranty period provided for in Section 3.1.1 Xxxxxxxx shall generate and maintain for one (1) year Packaging Line production records and make them available for review by Keurig on reasonable notice during normal business hours.

The Facility shall be operating in the ordinary course of business consistent with past practice, with continuous production of on-specification propylene at a rate of at least 115,000 pounds per hour for each of the four days immediately preceding the Closing Date and on the Closing Date.
