Product Labels. 11.1 AMERSHAM agrees to ship all PRODUCTS with a joint PRODUCT label which prominently includes the name ENZO DIAGNOSTICS, INC. and AMERSHAM INTERNATIONAL plc with their respective company logos where appropriate. AMERSHAM further agrees to ship all PRODUCTS intact with ENZO's package inserts and any notice(s) appearing thereon.
Product Labels. All PRODUCTS will be labeled with the ENZO DIAGNOSTICS, INC. label. DAKO further agrees to ship all PRODUCTS intact with ENZO's package inserts and any notice(s) appearing thereon.
Product Labels. All Products will be labeled to reflect the Company as the manufacturer and Xxxxxx as the distributor. The Company will work with Xxxxxx to ensure Product Part numbers avoid conflicts for Xxxxxx. Xxxxxx shall have the right to review and approve all labeling for the Products (including package inserts/IFUs, product brochures, surgical techniques and web-site materials), and the Company agrees to make modifications to such labeling for the Products as reasonably requested by Xxxxxx. If applicable, the Company will have sole responsibility for obtaining all necessary Product labels and for negotiating the language of the Product labels and package insert/IFU with the applicable Regulatory Authorities in the Territory; however, the Company will not propose or agree to specific content without Xxxxxx’x prior approval.
Product Labels. Dealer and/or the Dealer’s customers will not, in part or whole, obstruct, destruct, alter, cover, or tamper with, in any manner, the integrity of the label(s) affixed to Products at time of shipment. Violation of this restriction by Dealer and/or the Dealer’s customers constitutes both a material breach of this Agreement and shall void any expressed and/or implied Product warranty by SunRotor, its sub-contractors and/or material suppliers.
Product Labels. Misonix agrees that it will not sell or make available for sale any Products with Distributor’s name or label on such Products, nor shall Misonix otherwise sell or make available for sale any Products under Distributor’s name. Within 30 days after the Termination Date, Misonix shall (i) affix appropriate labels to all generator Products, including without limitation, the generator Products at customer locations for customers with Sonastar Contracts and/or potential customers who may be evaluating the Products and (ii) remove any labels on the generator Products wherever located that have Distributor’s name or contact information or in any way reference Distributor, such that the customers may clearly identify that Misonix is to be contacted for any product ordering, questions or repair needs. Distributor agrees to cooperate with Misonix at Misonix’s reasonable request in making the label changes set forth above, and each party shall be responsible for its own costs with respect thereto.
Product Labels. If requested by XenaCare for specific and designated markets MSI will supply products to XenaCare with appropriate product labels providing information in compliance with the applicable laws and regulations of Territory.
Product Labels. 10.1.1 Distributor shall ensure that the Product is sold and advertised in the form and with the labelling or marking required by the law of the Territory.
Product Labels. Following the Closing, Purchaser shall modify the electronic version of Seller’s labels (the “Labels”) for the Permethrin Products (and any printed labels derived therefrom) and shall, among other things, remove all references to Seller and Seller’s Affiliates or predecessors, except as required by law. Except for the removal of Seller’s name from the Labels as referred to in the immediately preceding sentence, Purchaser shall be permitted to exhaust its supply of the Labels as currently drafted without limitation for a period of six (6) months or the supply of labels is depleted, whichever occurs earlier; Seller specifically agrees not to assert any claim for copyright violation in connection with Purchaser’s future use of the Labels.
Product Labels. If requested by XenaCare for specific and designated markets Nutra will supply products to XenaCare with appropriate product labels providing information in compliance with the applicable laws and regulations of Territory.
Product Labels. During the Distribution Term and any applicable Transition Period, X-spine shall have sole responsibility for obtaining all necessary Product labels and for negotiating the language of the Product labels with the applicable Regulatory Authorities in the Territory. All labels (and any changes to labels) shall, without limitation, include both Zxxxxx- specific and X-spine-specific part numbers and be subject to approval of Zxxxxx prior to implementation, except as required by Applicable Law. X-spine shall establish and maintain procedures to control label integrity, inspection and storage and to control operations of labeling used for each production unit, lot or batch to prevent labeling mix-ups. X-spine shall control the packaging and labeling of the Products to ensure conformance to their respective Specifications and Applicable Laws.
