ATTACHMENT A Waiver for Sick Leave Buy Out – Article 34 I have requested payment for accrued sick leave (payable at the rate of one half its value) as is customarily paid to retiring employees taking service retirements. However, I acknowledge by my signature below that I have applied for an industrial disability retirement and that I understand that if I receive such a retirement I will not be eligible to receive pay for accrued sick leave and must refund the full amount of such pay to the City. I hereby agree to make such a repayment in full of all accrued sick leave within thirty (30) business days of receiving notice that my application for industrial disability retirement has been granted. I acknowledge that failure to do so may result in the City taking legal action against me to collect the amount I have received for accrued sick leave and that I may be subject to paying interest at the then prevailing legal rate on the amount owed, court costs and attorney fees. Policy Manuals. 10.1 Except as modified by a specific provision of this agreement, the Fire Rescue Department (FRD) Administrative Policy and Procedures Manual (“APP”) and the County's Personnel Policy & Procedure Manual (“PPPM”) in place at the time of ratification of this Agreement thereto shall govern the employees covered under this Agreement. However, in the event of a conflict between the PPPM and this Agreement or the APP and this Agreement, this Agreement will control.
