Pieceworkers Clause Samples
Pieceworkers. Piecework rates may be fixed by agreement between the Company and an employee at such rates as will enable the average competent employee to earn during ordinary working hours not less than the minimum federal wage.
Pieceworkers. 3.4.1 The Employer may engage casual Employees as pieceworkers.
3.4.2 The Employer will determine a piecework rate based on the nature of the work to be undertaken and the conditions under which it is performed to enable a reasonably competent Employee to earn during ordinary working hours an amount not less than the ordinary rate contained in this Agreement.
3.4.3 If the Employer and an Employee agree to undertake piecework an agreement in the form of Schedule B will be entered.
Pieceworkers. [See Pay Plus Bonus Addendum] Whenever pieceworkers are to be used for taking inventory, they shall be used in departments in which they are familiar with the items to be inventoried. Pieceworkers who are selected will receive their average hourly rate, unless otherwise mutually agreed.
Pieceworkers. Where a pieceworker's travelling time to and from work is composed of riding, driving and/or walking time, he will be paid for all travelling time in excess of (2) hour each way at the regular straight time skidder operator hourly rate. Average travelling time for each cutting block will be agreed to between the Company and the Union. For the purpose of this Agreement it is agreed that the pieceworker will walk at the rate of three (3) miles per hour. Hearst shall be deemed to be the marshalling point.
Pieceworkers. An employee must have demonstrated their ability to work piecework for five (5) consecutive days within thirty (30) days. Any partial day or days when an employee is told to go home because of no work shall be considered as working days. This time must be worked prior to the date the layoff occurs. Holidays coming within this period of time will be considered as days worked. The effective date in determining when the thirty (30) day trial period starts will be the day the employee files their bid in the Employment Office or in the case of transferred employees, the date on which the employee has been notified they are going to be transferred.
Pieceworkers. (i) The amount payable to pieceworkers under this clause is an amount calculated by multiplying the guaranteed minimum daily payment set out in Clause 3 by four (4).
(ii) (x) Amounts payable for work performed or Waiting Time incurred pursuant to Clause 4.2 shall be offset against the above amounts unless the work or tally performed on any day has been adjusted to include allowances and penalties paid under this Agreement.
Pieceworkers. 28.1. The Company and a full-time, part-time or casual employee may enter into an agreement for the employee to be paid a piecework rate. An employee being paid a piece rate is a pieceworker.
28.2. In this clause:
a) the average productivity of a pieceworker competent at the piecework task over a period is calculated by dividing the total output of the pieceworkers competent at the piecework task over that period by the total of the hours worked on the piecework task by the pieceworkers competent at the piecework task over that period (where output is measured in the same unit used to specify the piece rate, for example, a punnet, bucket or kilogram);
b) hourly rate for the pieceworker means the minimum hourly rate for the pieceworker’s classification level, plus for a casual pieceworker the 25% casual loading under clause 25.2 of this Agreement;
c) pieceworker competent at the piecework task means a pieceworker who has at least 76 hours’ experience performing the task (for example, picking apples, picking strawberries or pruning grape vines).
28.3. A piecework rate is paid instead of the hourly rate prescribed in Schedule B – Rates of Pay. The Company must fix the piece rate at a level such that a pieceworker working at the average productivity of a pieceworker competent at the piecework task will earn at least 15% more per hour than the hourly rate for the pieceworker. The piecework rate agreed is to be paid for all work performed in accordance with the piecework agreement.
28.4. Employees will be advised of the piecework rate applicable for that activity, block and crew prior to starting.
28.5. The Company must give the individual a copy of the piecework agreement.
28.6. The Company must keep the following as employee records:
a) a copy of each piecework record given to the pieceworker; and
b) a record of all hours worked by the pieceworker and the applicable piece rate at the time those hours were worked.
28.7. Despite any other provision of clause 28, a pieceworker must be paid for each day on which they work no less than the hourly rate for the pieceworker multiplied by the number of hours worked on that day.
28.8. If a pieceworker does any work in addition to the task for which they are being paid a piece rate, the pieceworker must be paid for that additional work at the hourly rate for the pieceworker.
28.9. For the purposes of the NES the base rate of pay and full rate of pay of a pieceworker are the same and are worked out as follows:

Pieceworkers. Any pieceworker eligible for sick leave shall be paid sick pay at the rate of 6 2/3 hours of the daily rate specified hereunder, for each completed month of service.
Pieceworkers. With the agreement of either the employee or the employer, the Employer may employ an employee as a pieceworker and the parties agree that such an employee is a dependent contractor within the meaning of the Ontario Labour Relations Act. A pieceworker shall be compensated with respect to payment of wages as provided for in Appendix AB@ which forms part of this agreement. All employee benefits, contributions, dues and other payments under this agreement must be paid in respect of pieceworkers. To determine the amount payable in respect of a pieceworker the Employer shall refer to the hourly package as provided for in Appendix AA@ which forms part of this Agreement. The employer shall make payments for each hour actually worked by a pieceworker, regardless of any ratio of time worked per fixture that may be indicated by the piecework wages as provided for in Appendix AB@. However, for each week in which a pieceworker performs any work, the employer=s payments shall not exceed an amount equivalent to forty (40) hours, regardless of the actual hours worked by the pieceworker in that week. In the event that a pieceworker employs or otherwise engages or works together with another person or persons to perform bargaining unit work, the pieceworker shall be deemed to be an independent contractor and shall first become signatory to this collective agreement prior to performing any work.
Pieceworkers. (a) Employees who are employed on a piece work system shall sharpen their knives or any other tool that the employees are required to sharpen and keep sharp in the performance of their duties, at times which do not interfere with the smooth running of the system.
(b) Provided that should a piece worker be required to work the hours prescribed in Clause 2.4 (Hours of Work) of this Agreement sufficient time shall be allowed by the employer to sharpen knives or any other tool that the employees are required to sharpen and keep sharp in the performance of their duties.
