Owner’s Right to Suspend Work. The Owner reserves the right, with or without the concurrence of the Design Professional, to suspend the Work at any time or from time to time at the Owner's sole discretion, upon giving Contractor five days advanced written notice thereof. If the Owner exercises this right and then resumes the Work covered hereby, Contractor shall be entitled upon timely claim to a Change Order for payment by Owner of any reasonable Actual Costs actually incurred by Contractor in connection with the suspension and resumption of the Work, as well as an extension in the time for performance of the Work to the extent Contractor is delayed by Owner's suspension, to include compensation based upon the rate for Time Dependent Overhead Costs. The Design Professional shall determine the time, which shall be binding upon both Owner and Contractor, as set forth in Section 3, Part 3.

Owner’s Right to Suspend Work. The Owner may at any time suspend the Work or any part thereof, immediately and verbally for reasons of safety, or by giving reasonable notice to the Contractor in writing. The Work shall be resumed by the Contractor within ten (10) days after the date fixed in the written notice from the Owner to the Contractor to do so. If the work is later determined by the Design Professional to be in fact conforming work, then CM/GC, for the period commencing 72 hours after the issuance of the initial stop work order, shall be entitled, upon timely claim to a Change Order, to payment by Owner of any reasonable Actual Costs incurred by CM/GC in connection with the stop work order and resumption of the work, as well as to a non-compensable extension in the time for performance of the work to the extent CM/GC is delayed by Owner's stop-work order beyond the initial 72 hours.
Owner’s Right to Suspend Work. The Owner may, at any time and upon reasonable notice to the Vendor, order the Vendor, in writing, to suspend all or any part of the Work for such reasonable period of time as the Owner may reasonably determine to be appropriate for its convenience. Any request by the Vendor for a change in the Specifications caused by the Owner's suspension of the Work pursuant to this subsection 25.1 will be subject to the review and reasonable acceptance of the Owner. No modification to the Specifications will be made to the extent that performance is, was or would have been suspended, delayed or interrupted for any other cause due to the Vendor's fault or if the suspension had no effect on agreed upon performance deadlines and/or Project Milestones set forth in this Contract. In the event of any such suspension, the Vendor will be compensated for any actual and reasonable loss, actual and reasonable damages or actual and reasonable expenses arising directly from such delay, including but not limited to payments contractually required under any Subcontractor agreements and reimbursement of reasonable expenses associated with the necessary re-deployment of the Vendor's resources; provided that the Vendor will in such event use reasonable efforts to estimate and report to the Owner any such costs or expenses prior to the commencement of any such Owner suspension pursuant to this subsection 25.1.

In such event, the GMP and Project Schedule shall be equitably adjusted, which adjustment shall include the reasonable costs of shutdown, delay and remobilization, including reasonable overhead and profit thereon.
