OWNER’S AGENT. Owner has hired Capstone On-Campus Management, LLC (“Agent”) as its property manager to conduct and handle all business for the Residential Facility. This includes addressing select Licensee issues, establishing and enforcing certain policies and procedures, and collection of License Fees. Agent will handle all matters regarding issues, policies and procedures outlined in the Owner’s policies for University housing (“University Housing Policies”). Note that when the term “Owner” is referenced herein, Agent is authorized to act on the Owner’s behalf.
OWNER’S AGENT. Whenever this Agreement is signed by, or whenever the Resident pays the rent to a property manager, management company or other agent of owner, such person or persons shall be considered as Landlord of the premises, and shall be authorized to prosecute unlawful detainer actions in the name of the property manager or property management company or other named agent as authorized by 369 of the Code of Civil Procedure of the State of California without joining the owner of record or title owner as plaintiff.
OWNER’S AGENT. 5.1 The Owners hereby covenant with the Council and the County Council not to carry out a Material Operation (Statutory) pursuant to the Planning Permission within each Main Phase unless and until the Owners have notified the Council and the County Council of the identity of the Owners’ Agent for the relevant Main Phase including the name of such person, business address of such person, telephone number of such person and e-mail address of such person including reasonable evidence that the owners of the freehold interest of no less than 75% of the land within the relevant Main Phase agree with the identity of such Owners’ Agent. 5.2 For the avoidance of doubt the Owners may notify the Council and the County Council of a change of identity of the Owners’ Agent for any particular Main Phase and the Council shall accept such person as the new Owners’ Agent for the purposes of this clause and clause 1717 provided that the Owners provide reasonable evidence that the owners of the freehold interest in no less than 75% of undeveloped land within the relevant Main Phase agree with the identity of such new Owners’ Agent.

Issues, policies and procedures not the responsibility of the Agent will be directed to the University of Maryland, Baltimore County (“UMBC” or “University” or “Residential Life” or “RL”). Note that when the term “Owner” is referenced herein, Agent is authorized to act on Owner’s behalf. Additionally, reference to Agent or Capstone herein shall also include any successor agent designated by Owner.

Note that when the term “Owner” is referenced herein, Agent is authorized to act on Owner’s behalf. Additionally, reference to Agent or Capstone herein shall also include any successor agent designated by Owner. The Agent, however, is not authorized to act on behalf of the University.
OWNER’S AGENT. An Owner's agent may act as an agent for the Owner only. An Owner's agent or subagent has the following affirmative obligations: To the Owner: A fiduciary duty of utmost care, integrity, honesty, and loyalty in dealings. To a potential buyer/lessee and the Owner: a. Diligent exercise of reasonable skills and care in performance of the agent's duties. b. A duty of honest and fair dealing and good faith. c. A duty to disclose all facts known to the agent materially affecting the value or desirability of the property that are not known to, or within the diligent attention and observation of, the Parties. An agent is not obligated to reveal to either Party any confidential information obtained from the other Party which does not involve the affirmative duties set forth above.
OWNER’S AGENT. Owner shall designate an Owner's Agent who shall have authority to act on behalf of Owner on all matters relating to this Agreement. Owner's Agent shall have authority to provide notice to and receive notice from Contractor and to exercise all other authority of Owner as permitted or required by this Agreement.
