Operating Protocols. The Parties to the Agreement to which this exhibit is attached are responsible to comply with all of the following protocols before, during and after use of each other’s facilities designated in Exhibits “A” and “B.” Failure to comply with such protocols may be considered to be a material breach of the agreement to which this exhibit is attached. Updates to these protocols may be made at any time if agreed to in writing by both the Superintendent or designee and the Director, Parks and Recreation or designee.
Operating Protocols. In order to assist the development of the operating procedures, the Company shall prepare and on signing of this agreement deliver to the operating committee, proposed protocols for the operation of the Facility and its interface with the JPS Interconnection Facilities.
Operating Protocols. (a) The Company has established certain operating protocols that are consistent with the OATT.
(b) If the Company provides terms in any of its agreements with a Member that are more favorable to a Member than those granted to any other Member, all Members similarly situated (including any member of a Member) shall be entitled to such terms. Within five (5) Business Days following the date hereof, Purchaser shall (a) adopt Seller’s Operating Protocols, with modifications to such protocols only to (i) replace references to Seller with references to Purchaser and (ii) update contact information contained in such protocols, including new OSROs that the Purchaser may designate, and (b) file such adopted operating protocols with the USCG as necessary or otherwise directed by the USCG.

Operating Protocols.
