DIR makes no representations or express or implied warranties whatsoever that any particular number of purchase orders will be issued or that any particular quantity or dollar amount of Cellular Voice and /or Data Access services will be procured through this contract. State agency-customers are required to order Cellular Data Access Services through a DIR sponsored contract unless they first obtain a waiver from the Telecommunications Planning and Oversight Council. As of the date of execution of this Contract, the TPOC has granted a blanket waiver to state agencies related to Cellular Voice and Data Access Services. Political subdivision and institutions of higher education, whether public or private, are authorized to use the DIR sponsored contracts but are not mandated to do so.
