No Equitable Relief. In the event of a breach of this Agreement by Company, the rights and remedies of Investor shall be limited to the right to recover monetary damages, if any, in an action at law and in no event shall Investor be entitled to enjoin or restrain the production or distribution or exhibition of the Picture or any element thereof, or the use, publication, or dissemination of any advertising or marketing issued in connection therewith, and Investor irrevocably waives any right to equitable or injunctive relief.
No Equitable Relief. In the event of a breach of this Agreement by Production Company, the rights and remedies of Funder shall be limited to the right to recover monetary damages, if any, in an action at law and in no event shall Funder be entitled to enjoin or restrain the distribution or exhibition of the Picture, or the use, publication, or dissemination of any advertising issued in connection therewith and Funder irrevocably waives any right to equitable or injunctive relief.
No Equitable Relief. No waiver by either party of any breach hereof shall be deemed a waiver of any preceding or succeeding breach hereof. Notwithstanding any other provision of this Agreement, LP's sole remedy for breach by TAG of any of its obligations under this Agreement shall be an action at law for damages and LP acknowledges that such damages are fully adequate to compensate LP in the case of any breach by TAG hereunder. In no event shall LP seek or be entitled to rescission, injunctive or other equitable relief.
No Equitable Relief. In the event of a breach of any of Production Company’s obligations pursuant to this Agreement, Artist’s sole remedy, which Artist acknowledges to be wholly adequate, shall be an action at law for damages and in connection herewith, Artist hereby waives any rights to any equitable relief whether by way of injunction or otherwise.
No Equitable Relief. Notwithstanding anything to the contrary, in no event shall Author be entitled to terminate or rescind any of the rights granted hereunder, and Author’s remedy for any breach of this Agreement by Publisher, including failure to pay any part of the consideration, shall be limited to an action at law for monetary damages, and under no circumstances shall Author be entitled to any injunctive relief, whether based on statute, common law, or otherwise. • Errors. Publisher shall not be held responsible for errors in the Licensed Work(s), including without limitation spelling, grammar, punctuation, missing words, work style, corrupted files, computer formatting errors. Author is responsible for submitting a professionally edited manuscript and for proofreading the final proof prior to delivering the Licensed Work(s) to Publisher.
No Equitable Relief. In the event of a breach hereof, the non-breaching party shall not be entitled to any equitable remedies under this Agreement or applicable law.
No Equitable Relief. All rights granted and agreed to be granted to Producer under this Agreement shall be irrevocably vested in Producer (including, without limitation, for the full term of copyright protection everywhere in the world and any and all renewals thereof). No breach of this Agreement shall entitle Owner to equitable relief, whether injunctive or otherwise, against the Picture or any other works produced pursuant to the Rights herein granted. If the rights granted to Producer hereunder should revert to Owner pursuant to the provisions of any copyright law or similar law, and if Owner is at any time thereafter prepared to enter into an agreement with a third party for the license, exercise or other disposition of all or any of such rights, Owner shall, before entering into such agreement, give Producer notice of the proposed terms thereof (and all modifications of such terms) and the party involved. In each instance, Producer shall then have ten (10) business days in which to elect to acquire the rights involved on the terms contained in the notice.
No Equitable Relief. Notwithstanding any other provision to the contrary contained in this Agreement, each Party acknowledges and agrees that (i) monetary damages at law are a fully adequate remedy to compensate the other Party for any breach or threatened breach of this Agreement, and (ii) an action at law for monetary damages is such Party’s sole and exclusive remedy for any such breach. No breach by any Party of this Agreement will entitle the other Party to equitable relief, including specific performance, injunctive relief, rescission or any other form of equitable remedy.
No Equitable Relief. In the event of a breach of this Agreement by Production Company, the rights and remedies of Volunteer shall be limited to the right to recover monetary damages, if any, in an action at law and in no event shall Volunteer be entitled to enjoin or restrain the distribution or exhibition of the Picture, or the use, publication, or dissemination of any advertising issued in connection therewith and Volunteer irrevocably waives any right to equitable or injunctive relief.
No Equitable Relief. No breach by CKC of this Agreement will entitle you to equitable relief, including specific performance, injunctive relief, rescission, or any other form of equitable remedy. Without limiting the generality of the immediately preceding sentence, you shall not seek equitable relief to rescind this Agreement or seek injunctive relief to enjoin or otherwise restrain or limit the use or other exploitation of the Work or any rights therein.
