Mysterious Disappearance. This is an unexplained loss of property. It includes loss of or misplacing property. PERSONAL PROPERTY CONDITIONS
Mysterious Disappearance. Warehouse shall be liable for loss of Goods due to inventory shortage or unexplained or mysterious disappearance of Goods only if Depositor establishes that such loss occurred because of Warehouse’s failure to exercise the care required under section 12. Any presumption of conversion imposed by law shall not apply to such loss and a claim by Depositor of conversion must be established by affirmative evidence that Warehouse converted the Goods to Warehouse’s own use.

Mysterious Disappearance. SEC. 15 Warehouseman shall not be liable for loss of goods due to inventory shortage or unexplained or mysterious disappearance of goods unless depositor establishes such loss occurred because of warehouseman’s failure to exercise the care required of warehouseman under Section 11 above. Any presumption f conversion imposed by law shall not apply to such loss and a claim by depositor of conversion must be established by affirmative evidence that the warehouseman converted the goods to the warehouseman’s own use.
Mysterious Disappearance. LEMAN USA shall be liable for loss of Goods due to inventory shortage or unexplained or mysterious disappearance of Goods only if Customer establishes such loss occurred because of LEMAN USA’s failure to exercise the care required of LEMAN USA under Section 12 above. A discrepancy rate of 1.0% is acceptable on the total inventory value at the time of any physical inventory count, not to exceed $1,000 annually. Any missing merchandise over and above this rate according to LEMAN USA’s computer records is payable by LEMAN USA at the rate stated in Section 12 above. Any presumption of conversion imposed by law shall not apply to such loss and a claim by Customer of conversion must be established by affirmative evidence that the LEMAN USA converted the Goods to LEMAN USA’s own use.
Mysterious Disappearance. GAC shall not be liable for loss of Goods that had been tendered to GAC for storage due to inventory shortage or unexplained or mysterious disappearance of Goods unless the Customer establishes that such loss occurred because of GAC’s failure to exercise reasonable care, in which case, damages are limited as per Section 12, above. Any presumption of conversion imposed by law shall not apply to such loss and a claim by the Customer of conversion must be established by affirmative evidence that GAC converted the Goods to GAC’s own use.
Mysterious Disappearance. SPE shall be liable for loss of Goods due to inventory shortage or unexplained or mysterious disappearance of Goods only if Client establishes such loss occurred because of SPE’s failure to exercise the care required of SPE under Section 15(a) above. Any presumption of conversion imposed by law shall not apply to such loss and a claim by Client of conversion must be established by affirmative evidence that SPE converted the Goods to SPE’s own use.
Mysterious Disappearance. Gateway shall not be liable for loss of goods due to inventory shortage or unexplained or mysterious disappearance of goods unless Customer establishes such loss occurred because of Gateway’s lack of reasonable care. Any presumption of conversion imposed by law shall not apply to such loss and a claim by Customer of conversion must be established by affirmative evidence that Gateway converted the goods to Gateway’s own use.
Mysterious Disappearance a. Gulf Winds shall be liable for loss of Goods due to inventory shortage or unexplained or mysterious disappearance of Goods only if Customer establishes such loss occurred because of Gulf Winds’ failure to exercise the care required of Gulf Winds under Section 13 above, and then Gulf Winds’s maximum liability shall be for the lost Goods as specified in Section 13 above. Any presumption of conversion imposed by law shall not apply to such loss and a claim by Customer of conversion must be established by affirmative evidence that Gulf Winds converted the Goods to Gulf Winds’ own use.
Mysterious Disappearance. R+L GLOBAL shall not be liable for loss of goods due to inventory shortage or unexplained or mysterious disappearance of goods unless DEPOSITOR establishes such loss occurred because of R+L GLOBAL’s failure to exercise the care required of R+L GLOBAL under Section 8 above. Any presumption of conversion imposed by law shall not apply to such loss and a claim by DEPOSITOR of conversion must be established by affirmative evidence that R+L GLOBAL converted the goods to R+L GLOBAL’s own use.
