Liability Release. In consideration for U of R allowing me to participate in the Activity, I agree I will not xxx the Releasees and I hereby release and indemnify the Releasees from any and all liabilities, claims, demands, actions, causes of actions, costs and expenses of any nature whatsoever arising out of any loss, personal injury (including death) or property damage, that I may sustain , arising from the Activity or while upon the premises where the Activity is being conducted, unless due directly to the gross negligence or willful misconduct of the Releasees.
Liability Release. In consideration for the University allowing me to participate in the Activity, I agree I will not xxx the University and I release the University from any and all liabilities, claims, demands, actions, causes of actions, costs and expenses of any nature whatsoever arising out of any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, arising from the Activity or while upon the premises where the Activity is being conducted, excepting those claims arising from the gross negligence or willful misconduct of the University.
Liability Release. In consideration for RIT allowing the Participant to participate in the Activity, I and the Participant agree not to xxx the Releasees and release the Releasees from any and all liabilities, claims, demands, actions, causes of actions, costs and expenses (“Claims”) of any nature whatsoever which I and/or the Participant may have arising out of any loss, damage, or injury, including death, that may be sustained by me and/or the Participant or to any property belonging to me or the Participant, arising from the Activity or while upon the premises where the Activity is being conducted regardless of how such Claims may arise and regardless of who is at fault, even if caused by the neglect or fault of Releasees, excepting those Claims arising from the gross negligence or wilful misconduct of the Releasees.
Liability Release. I understand that participating in the Purdue EMG Program can involve certain risks to me. I accept those risks. I hereby discharge Purdue University, the Trustees of Purdue University, the county commissioners, the Purdue Extension county office, and each of their trustees, officers, appointees, agents, employees, and volunteers (“Released Parties”) from all claims that I might have for any injury or harm including death, arising out of my participation in any activity related to the Purdue EMG Program, even if such injury or harm is caused by the negligence or fault of any of the Released Parties. I do not, however, release these individuals and entities from liability for intentional, willful, or wanton acts and this release shall not be construed to include such acts. • First Aid. I give permission for Purdue EMG Program and its representatives, and emergency personnel to make necessary first aid decisions if I am injured or fall ill while participating in Purdue EMG Program activities. I shall be financially responsible for the cost of any medical treatment.
Liability Release. Northern States Power Company shall not be responsible for monitoring or taking any steps to ensure that the Community Solar Garden Operator maintains the confidentiality of the Subscriber’s Account Information, the Subscriber’s Energy Usage or the Bill Credits received pertaining to the Subscriber’s participation in the Community Solar Garden. However, Northern States Power Company shall remain liable for its own inappropriate release of Subscriber’s Account Information and Subscriber’s Energy Use Data.
Liability Release. To the extent permitted by applicable law, Symantec will have no liability for loss of or recovery of data, programs, or loss of use of systems(s) or networks arising out of the Services or any act or omission, including negligence, by Symantec and/or its representatives. If Symantec works with You on any password or other access control oriented problems, Symantec strongly recommends that You reset such passwords(s) immediately following the completion of the Services.
Liability Release. I FREELY ACCEPT AND VOLUNTARILY ASSUME ALL RISK OF PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH TO ME OR MY CHILD OR XXXX WHICH OCCURS AT ATTITASH MOUNTAIN RESORT, WILDCAT MOUNTAIN SKI AREA, OR CROTCHED MOUNTAIN SKI AND RIDE FROM WHATEVER CAUSE, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF L.B.O. Holding, Inc., d/b/a Attitash Mountain Resort, WC Acquisition Corp. d/b/a Wildcat Mountain Ski Area, SNH Development Inc. d/b/a Crotched Mountain Ski and Ride, Peak Resorts, Inc., and their officers, directors, shareholders, employees, agents, assigns and affiliates (hereafter “RELEASEES”). I understand that the RELEASEES are not responsible for the consequences of their own NEGLIGENCE, that is, their failure to use reasonable care in any way. In entering into this Liability Release Agreement with the RELEASEES, I intend to release all claims I may have against the RELEASEES, not just claims arising out of the inherent risks of alpine sports activities. To the extent that I am signing this document on behalf of any minor, I represent and guarantee that I have full authority to do so, realizing the full binding effect of this Agreement on them as well as on myself. I further agree for myself or my child or xxxx to indemnify, defend and hold harmless RELEASEES for any claims brought by or on behalf of myself or the minor, including any lawsuits, legal fees, expenses or settlements. I acknowledge that my child may spend some of their clinic in the Attitash Nursery, Kitten Club Nursery or Radical Kids Center. If any portion of this agreement is deemed unenforceable, the remainder shall be given full force and effect. I further agree that any claim that I bring for any reason against the RELEASEES, shall be submitted to the jurisdiction of the State or Federal Court of New Hampshire. This Agreement shall be interpreted to provide as broad and inclusive a release of liability as is legally possible, but is not intended to assert any claims or defenses that are prohibited by law. I agree that if any portion of this Agreement is determined to be unenforceable by a court of law, all other parts shall remain in full force and effect and that this Agreement shall be binding upon my heirs and assigns.

TO THE FULLEST EXTENT PERMITTED BY LAW, AND AS A MATERIAL PART OF THE CONSIDERATION PROVIDED UNDER THIS AGREEMENT, THE CLUB DOES HEREBY FULLY, FINALLY AND COMPLETELY RELEASE, ACQUIT, REMISE, AND FOREVER DISCHARGE THE DISTRICT AND ITS OFFICIALS, TRUSTEES, OFFICERS, AGENTS, EMPLOYEES, INDEPENDENT CONTRACTORS, STUDENTS, VOLUNTEERS, AND REPRESENTATIVES OF AND FROM RESPONSIBILITY FOR, WAIVES THE CLUB’S ENTIRE CLAIM OF RECOVERY FOR, AND ASSUMES ALL RISK OF ANY AND ALL CLAIMS, EXPENSES, AND DEMANDS FOR COMPENSATION, OF EVERY KIND AND NATURE WHATSOEVER, RELATING TO, ARISING OUT OF, OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO (A) LIABILITY ARISING FROM THE CLUB’S ACCESS TO DISTRICT FACILITIES, (B) DAMAGE TO PROPERTY OR INJURY TO PERSONS (INCLUDING DEATH) IN OR ON THE PROPERTY FROM ANY CAUSE WHATSOEVER; AND (C) BUSINESS INTERRUPTION OR OTHER CONSEQUENTIAL DAMAGES. THIS RELEASE AND DISCHARGE IS INTENDED TO APPLY EVEN THOUGH THE LIABILITY MAY ARISE OUT OF THE NEGLIGENCE OR CARELESSNESS ON THE PART OF THE DISTRICT OR ITS OFFICIALS, TRUSTEES, OFFICERS, AGENTS, EMPLOYEES, INDEPENDENT CONTRACTORS, STUDENTS, VOLUNTEERS, AND REPRESENTATIVES.
