Layoff/Bumping Clause Samples
Layoff/Bumping. In the event the City should lay off police personnel, such layoffs shall be solely in accordance with this Article and in lieu of any provisions in Chapter 124 of the Ohio Revised Code or any conflicting provisions of the City Charter or City policy. For the purpose of this agreement, seniority shall be the total service within a sworn police position with MPD less any time, which constitutes a break in service. For layoff only, seniority shall constitute time in rank, subject to the provisions herein.
1. Patrol officers with the least seniority shall be laid off first.
2. In the event the City should reduce the number of police supervisors, the supervisors with the least time in rank shall bump to the next lower rank.
3. In the event the City should reduce the number of Deputy Chiefs, such Deputy Chief shall bump to the lower rank of Lieutenant. A Deputy Chief reduced in rank shall bump the Lieutenant with the least amount of time in grade. A Lieutenant reduced in rank shall bump the Sergeant with the least amount of time in grade and a Sergeant reduced in rank shall bump the least senior Patrol Office. A supervisor bumped into a lower supervisory rank will be placed in the lower rank based upon the employee’s total time as a supervisor for the Middletown Police Department. Once bumped into the patrol rank, the bumped member shall become the senior ranking officer in the patrol rank for the purposes of recall only. For layoff purposes, the employee bumped into the patrol rank is placed according to his departmental seniority. This bumping procedure shall continue until no lower rank exists.
4. An employee who is reduced in rank shall be reinstated to their previous rank in reverse order of bumping and before any competitive test is given for a supervisory opening.
5. In the event a member is laid off, he shall receive payment for earned but unused vacation and/or holiday (to include current calendar year) sick leave conversion, uniform maintenance, and clothing allowance with his termination pay.
Layoff/Bumping. The City of Encinitas and the San Dieguito Water District shall be considered separate employers for the purpose of administration of layoff bumping procedures.
Layoff/Bumping. In the event of a layoff (force reduction) which affects an employee(s) of the department, the reduction of the work force within the bargaining unit shall be accomplished by layoff of the employee within the department who has the least department seniority within the group.
Layoff/Bumping. In the event a Association employee(s) be laid off, and there is no bumping advantage, this employee will be considered for the next position opening that they qualify for, regardless of whether they have previously held the classification.

Layoff/Bumping. A. In the event of a layoff, the City shall notify the Union as far in advance as possible.
B. There shall be three (3) classifications under this section, being Firefighter/Paramedic, Firefighter/EMT and Lieutenant.
C. In the event the City decides to lay off members within a classification, the Chief will determine the number to be laid off, and the City will first lay off those members employed on a probationary basis in the classification.
D. If further layoffs are necessary, selection from among regular, full-time members in the classification shall be made as follows: Classification seniority shall be determinative as between employees the Chief determines have the same ability and skills to perform the work.
E. The senior Lieutenant, who would otherwise be laid off, depending on whether he is a Paramedic or an EMT, may bump the junior Firefighter/Paramedic or Firefighter/EMT over whom he has departmental seniority, provided the Chief determines he is qualified to perform all of the remaining work.
F. The senior Firefighter/Paramedic who would otherwise be laid off may bump the junior Firefighter/EMT employee over whom he has departmental seniority, provided the Chief determines he is qualified to perform all of the remaining work.
G. The employee who bumps into a lower classification under paragraphs (E) or (F) above shall be paid in the classification to which he bumps just as if he were demoted.
Layoff/Bumping. In a case where the employee's services are no longer required in their classification within their department (1. Road Crew/Office 2. Solid Waste, or 3. Utilities), the Employer may transfer laid off employees to any open position at the appropriate rate of pay for that position, without posting. If the employee is dissatisfied with the transfer, then within fourteen (14) calendar days said employee shall have the option of exercising the "bumping" provisions of the layoff procedure or of accepting layoff.
18.4.1 To bump an employee the employee doing the bumping must meet all of the following conditions:
1. Possess the minimum qualifications of the position they are bumping into.
2. The employee has greater seniority for layoff purposes in Local 334 than the employee whom they are bumping.
3. The position being bumped into shall not include the ▇▇▇▇▇▇▇ position.
18.4.2 Employees who successfully bump into a different position or differe nt department in accordance with this article, shall keep their seniority date (date of hire) from the department from which he/she is being laid off.
18.4.3 Employees who are reduced in hours as a result of layoff shall remain bargaining unit members and shall be covered by the collective bargaining agreement. Employees whose hours are reduced and who are regularly scheduled to work 126 hours or more a month will be entitled to pro-rated benefits, such as; health insurance, holidays, vacation leave, sick leave. Regular part time employees shall be paid at one and one-half (1.5) times the base hourly rate for authorized work in excess of forty (40) hours in the work week.
Layoff/Bumping. 8.1: Layoff shall mean a reduction in the work force due to a decrease of work or budget limitation as determined by the Employer.
A. When a layoff is determined to be necessary by the Employer, the Union shall be notified promptly.
B. The Union may request to meet with the Employer prior to implementing a layoff.
1. The Employer shall not be prohibited or constrained from instituting a layoff on the basis of attempting to facilitate a meeting.
A. Subject to emergencies, employees to be laid off will have no less than fifteen (15) calendar day’s written notice.
1. The ▇▇▇▇▇▇▇ and/or Chairperson shall be provided with a copy of the layoff notice given to the employee.
A. When a layoff is determined to be necessary, the layoff shall be made in the following order:
1. Temporary and/or Substitute Employees;
2. Probationary Employees;
3. Employees within the Department affected shall then be laid off by seniority within the classification affected.
B. The intent of this Section is to maintain operable departments in case of layoffs and is not to reduce most or all employees to regular part-time status. In the event two (2) or more employees have equal seniority, layoff shall be by employee birthday (month, day, then year).
1. The employee(s) with the first birthday in the year shall be considered to have the most seniority.
8.5: Names of the employees with seniority who are laid off from the department will be placed on the County recall list.
Layoff/Bumping. In the event of a layoff (force reduction) which affects an employee(s) of the Union, the reduction of the work force within a job group as outlined in Section 11.1 of this Article shall be accomplished by layoff of the employee within the job group who has the least seniority within the group. In lieu of layoff, an employee may exercise bumping rights into any position/job group, which the employee previously held based on union seniority. An employee served with notice of layoff must inform NFT Metro of his/her intentions to bump, within five (5) working days of receipt of layoff notice.
Layoff/Bumping. AND RECALL whether part-time or full-time, may bump either a part-time or full-time employee. Where a temporary position occupied by a regular employee is terminated, the employee shall revert to their previous position. The employee shall exercise bumping rights by informing the Employer of within seven (7) calendar days of receiving notice under above. Where an employee declines to exercise their right to bump, the right shall be forfeited for that layoff or reduction. Where an employee exercises the right to bump and subsequently is unable to perform adequately the duties of the position, the employee shall have the right to bump only the most junior employee whose position the employee is qualified to fill.
