Labor; Working Hours. A. Contractor shall provide competent, suitably qualified personnel to perform construction as required by the Contract Documents. Contractor shall at all times maintain good discipline and order at the Site. B. Except as otherwise required for the safety or protection of persons or the Work or property at the Site or adjacent thereto, and except as otherwise stated in the Contract Documents, all Work at the Site shall be performed during Regular Working Hours. Contractor will not permit the performance of Work beyond Regular Working Hours or for Weekend Working Hours without City’s written consent (which will not be unreasonably withheld). Written request (by letter or electronic communication) to perform Work: 1. for beyond Regular Working Hours, request must be made by noon at least two (2) Business Days prior 2. for Weekend Working Hours, request must be made by noon of the preceding Wednesday

Demolition Contractor shall at all times maintain good discipline and order at the Site. Except as otherwise required for the safety or protection of persons or the Demolition Work or property at the Site or adjacent thereto, and except as otherwise stated in the Contract Documents, all Work at the Site shall be performed during regular working hours, and Demolition Contractor will not permit overtime work or the performance of Work on Saturday, Sunday, or any legal holiday without Owner's written consent (which will not be unreasonably withheld).

Pay additional cost incurred by Owner for services of the OAR or RPR to observe Work constructed outside of regular working hours. OAR will issue a Set-off in the Application for Payment for this cost per Paragraph 17.01.B

CONTRACTOR, CONTRACTOR’s, Subcontractors and their respective employees shall at all times be subject to and follow the directives of the Westchester Medical Center Security forces and any and all other lawful authorities having jurisdiction. D. It is the CONTRACTOR’s responsibility to ensure that the wages to be paid and the supplements to be provided comply in all respects with the requirements of applicable law. Each laborer, worker or mechanic employed by the CONTRACTOR, Subcontractors or other persons doing or contracting to do the whole or any part of the Work described in the Contract Documents shall be paid the prevailing wages and provided the supplements (including but not limited to health, welfare and pension benefits) as required by Article 8 (Section 220-223) and Article 9 (230-239) of the New York State Labor Law. The “Schedule of Hourly Rates and Supplements” set forth in the Supplementary Conditions shows the minimum hourly rates of wages which can be paid and the minimum supplements that can be provided as of the date of the schedule. Unless otherwise approved by OWNER, such supplements shall be paid to a federally qualified Pension, Health and Welfare program and New York State Registered Apprentice Training Program. CONTRACTOR shall not utilize classifications not appearing on the rate sheet except with the consent of the OWNER and then the rate to be paid will be determined by the OWNER based upon the advice of the State Department of Labor. The Design-Build Entity shall at all times maintain good discipline and order at the Site. The Design-Build Entity will provide all labor needed to complete the Work within the Contract Times. B. Except as otherwise required for the safety or protection of persons or the Work or property at the Site or adjacent thereto, and except as otherwise stated in the Contract Documents, all Work at the Site shall be performed during regular working hours, which are defined as hours between 7:00 a.m. and 3:30 p.m. any day Monday through Friday of any week except on Holidays and/or during Schedule Constraints defined in the Contract Documents. The Design-Build Entity will not permit the performance of Work on a Saturday, Sunday, any Holiday or during identified Schedule Constraints without District’s written consent given after prior written notice to District’s Representative. The Design-Build Entity shall be responsible for, and shall reimburse District for, all inspection costs outside regular working hours, including overtime.
