Interpreting this Agreement. This Agreement must be interpreted using the following rules (unless it would not make sense to do so): a the Commercial Terms prevail over the General Terms if there is any inconsistency; b where we refer to any statute, we include all future versions of it, including all changes to it, all re-enactments or replacements of it, and all statutory instruments issued under it; c where we refer to a document we mean that document as varied or replaced from time to time; d each reference to us or you includes any person or entity that legally takes over our or your responsibilities (as applicable), and in the case of a party that is a trust, includes each trustee as well as the relevant trust; and

This Guaranteed Future Value Agreement is a Relevant Agreement for the purpose of any Finance Agreement. Any term of the Finance Agreement relating to giving notices, privacy and costs apply equally to this Guaranteed Future Value Agreement.
Interpreting this Agreement. Your organization agrees to indemnify and hold CPF harmless from and against any and all loss, damage, injury, and liability arising from the deposit, investment, use, or disbursement of funds pursuant to this agreement. This indemnity shall apply whether or not an indemnitee was claimed to be negligent. This letter does not constitute a partnership or join venture between CPF and the Park Partner. Neither party has the right to obligate the other in any manner whatsoever. The duties and obligations that the parties have agreed to perform under the terms of this letter agreement shall not be assignable to any third person or entity without the express written consent of the other party. Interpreting this Agreement. 15.1 This Agreement constitutes the entire agreement of the parties about the subject matters. Any previous agreements, understanding and negotiations on those subject matters have no effect.
