Industrial. The first two (2) hours of overtime daily Monday to Friday shall be paid at the rate of time and one-half (1%). All other overtime inclusive of work on Saturdays, Sundays or Statutory Holidays shall be paid at the rate of double time.

Industrial with respect to State miscellaneous members means death or disability resulting from an injury which is a direct consequence of a violent act perpetrated on his or her person by 1) a patient or client of the State Department of Mental Health at Patton State Hospital or Atascadero State Hospital, or 2) an inmate at the DMH Psychiatric Program at CMF Vacaville or 3) a patient or inmate at any other State facility in which employees participate in the State's safety membership retirement system if:
Industrial work, where a project requires twenty-five (25) or more Employees, the Employer may utilize the option in (b) above and in addition may name hire or transfer one (1) additional Employee for every five (5) list hires
Industrial. The Employer may schedule an afternoon and/or night shift as required. It shall not be necessary for there to be a day shift in order for there to be an afternoon and/or night shift. Two (2) consecutive days shall be necessary to constitute an afternoon shift and three (3) consecutive days shall be necessary to constitute a night shift. Where these shifts are not maintained for these consecutive working days, all time will be paid at overtime rates. The Employer shall pay a shift premium over and above the otherwise applicable minimum straight time hourly wage rate to any employee who is employed on an afternoon or night shift. The minimum straight time hourly wage rate applicable for all other employee classification shall be recalculated accordingly. Such shift premium shall be paid in accordance with the following schedule. Notwithstanding any contrary interpretation of the following schedule, a shiftcommencing at 3:30pm shall be deemed to be an afternoon shift and a shift commencing at 8:30pm shall be deemed to be a night shift. Overtime on afternoon and nights shifts shall be payable for all hours of work performed in excess of eight (8) hours per shift. These shift premiums will not be paid for Saturday, Sunday or statutory holidays. Day Shift: No shift premium Afternoon Shift: Six dollars ($6.00) per hour worked on any shift which commences between 3:30pm and 8:30pm second and subsequent meal breaks are not be considered to be hours worked. Night Shift: Six dollars ($6.00) per hour worked on any shift which commences between 8:30pm and before 1:01am second and subsequent meal breaks are not be considered to be hours worked.

Industrial. An employee disabled as a result of a work related injury or illness, will be granted an unpaid leave of absence once paid time off has been exhausted. Paid time off at the discretion of the employee may be integrated with Workers' Compensation Disability payments to the extent necessary to permit an employee to maintain his/her regular straight time earnings during the period of disability. The foregoing will be applicable to the extent the employee has paid time off accrued and not used. Initial requests for leave and extensions must be submitted in writing to the employee's supervisor, along with the physician's written certification of disability. Leaves will be granted in increments up to ninety days, to a maximum of one year. During industrial leave, service credit toward tenure step increase will continue to accrue for the period of the industrial leave. Employees returning from industrial leave and/or modified work assignment will be reinstated at the appropriate step rate in their former position.
