Health and Safety Legislation. The Provider shall (and shall ensure that all Staff, Sub-Contractors and other related parties shall) at all times comply with all relevant health and safety procedures which shall include the requirements of the Health and Safety at Work etc. Act 1974, all other applicable Law, its own health and safety policies and safe working systems (to be produced to the Bradford Children and Families Trust on request), and any relevant health and safety plans for the Bradford Children and Families Trust Premises. Each Party shall promptly notify the other of any incidents on the Bradford Children and Families Trust Premises or otherwise related to the provision of the Goods which are or may give rise to a health and safety or an environmental hazard. Breach by the Provider of this clause 27 shall be deemed a material breach incapable of remedy Environmental Law When working on Bradford Children and Families Trust Premises the Provider must perform its obligations in accordance with the Bradford Children and Families Trust's current policies in relation to the environment and sustainable communities as may be amended from time to time, and which deal with the Bradford Children and Families Trust’s approach to conserve energy, water, wood, paper and other resources, reduce waste and phase out the use of ozone depleting substances and minimise the release of greenhouse gases, volatile organic compounds and other substances damaging to health and the environment, and in accordance with all applicable environmental Law. The Provider acknowledges and agrees to support the Bradford Children and Families Trust’s commitments in relation to the environment and shall: gather and provide any information requested by the Bradford Children and Families Trust to demonstrate the Provider’s compliance with this clause 28; and participate in the development of local or regional multi-agency climate change quality indicators and or carbon reduction plans where required by the Bradford Children and Families Trust. Fairtrade Any commitments made in relation to Fairtrade certified standards in the supply chain of the Provider which were made as a result of a risk assessment during the Tender process shall be adhered to and delivered as per the Tender. Employee Representation and Union Recognition Union Recognition The Schools and employees recognise that: the IEU is the principal industrial representative of employees in Lutheran schools in the workplace relations context and has a legitimate right to advise members about all aspects of their employment. Employees have the freedom of choice to select whatever representative they choose. Union Access to Members and Other Employees Right of entry is governed by Part 3-4 of the Fair Work Act 2009. Union Communication Employees and the IEU are free to exchange information relative to industrial matters effecting the employees' rights, obligations and conditions of employment, WHS and other legitimate matters of interest, without interference from the School. To that end, material circulated to school staff via the postal system or by way of any electronic communication shall be passed on to the relevant employee(s) promptly. Schools reserve the right to examine or copy files or data on their information technology facilities to maintain a secure, efficient and effective information technology environment and to ensure compliance with all laws and customs.
