Hazardous Materials Brought On Site. Any hazardous materials brought into, used, stored or abandoned at the BellSouth Premises by ALEC Inc., are owned by ALEC Inc.,. ALEC Inc., will indemnify BellSouth for claims, lawsuits or damages to persons or property caused by these materials. Without prior written BellSouth approval, no substantial new safety or environmental hazards can be created by ALEC Inc., or different hazardous materials used by ALEC Inc., at BellSouth Facility. ALEC Inc., must demonstrate adequate emergency response capabilities for its materials used or remaining at the BellSouth Facility.

ACCESS Integrated will indemnify BellSouth for claims, lawsuits or damages to persons or property caused by these materials. Without prior written BellSouth approval, no substantial new safety or environmental hazards can be created by ACCESS Integrated or different hazardous materials used by ACCESS Integrated at a BellSouth Premises. ACCESS Integrated must demonstrate adequate emergency response capabilities for the materials used by ACCESS Integrated or remaining at a BellSouth Premises.
