Geofencing. For purposes of this Agreement, “geofencing” means the use of technology to create a virtual geographic boundary, enabling software to trigger a response when a micromobility device enters or leaves a particular area. Vendor shall coordinate within reason with the City regarding geofenced areas of operations for the purpose of eliminating or reducing speed conflicts between the stand-up electric scooters and other vehicles and pedestrians. The City’s Traffic Engineer and based upon considerations of public safety, pedestrian and vehicular traffic, mishandling of the stand-up electric scooters, requests from the public/stakeholders, criminal activity, construction and special events, may create designated areas where the electric scooters may not be operated or where the maximum operating speed must be reduced, and areas where electric scooters shall not be parked, but may still allow access of devices through the area. Vendor must have the technology available to implement these requirements upon reasonable notice.
