FIXED RATES. If a fixed rate is in this Agreement, it is based on an estimate of the costs for the period covered by the rate. When the actual costs for this period are determined, an adjustment will be made to a rate of a future year(s) to compensate for the difference between the costs used to establish the fixed rate and actual costs.
FIXED RATES. (i) Borrower shall deliver to the Minneapolis Loan Center of Administrative Agent, 000 Xxxxxxxxx Xxxxxx, 00xx Xxxxx, Xxxxxxxxxxx, Xxxxxxxxx 00000, with a copy to: Administrative Agent, Real Estate Group, 0000 Xxxxx Xxxxx Xxxx, Xxxxx 0000, Xxxxxxx, Xxxxxxx 00000, Attention: Loan Administration Manager, or such other addresses as Administrative Agent shall designate, an original or facsimile Fixed Rate Notice no later than 9:00 A.M. (Minnesota time), and not less than three (3) nor more than five (5) Business Days prior to the proposed Fixed Rate Period for each Fixed Rate Portion. Any Fixed Rate Notice pursuant to this subsection (i) is irrevocable. Administrative Agent is authorized to rely upon the telephonic request and acceptance of Xxxxxxx W.A. Xxxxxxx, Jr. or Xxxxxxx X. Xxxxxxxx, in their respective positions as Senior Vice President of the general partner of Borrower, as Borrower's duly authorized agents, or such additional authorized agents as Borrower shall designate in writing to Administrative Agent. Borrower's telephonic notices, requests and acceptances shall be directed to such officers of Administrative Agent as Administrative Agent may from time to time designate.
FIXED RATES. For authorized work in the Scope of Work described herein and fully set forth in Attachment A, psychological evaluation services will be at the rates set forth below. Services Rate
FIXED RATES. Fixed rates will remain fixed for the Term. Percentage Discounts will remain fixed for the Term, but Sprint may modify the underlying schedule rate (or list price for non-scheduled Services) against which Sprint applies Discounts.
FIXED RATES. (b) the LIBOR Rate plus 1.75 percentage points.
FIXED RATES. The Remarketing Agent shall determine the Fixed Rate for the Bonds being converted to the Fixed Rate Mode in the manner and at the times as follows: not later than 4:00 P.M. on the applicable Rate Determination Date, the Remarketing Agent shall determine the Fixed Rate. The Fixed Rate shall be the minimum interest rate which, in the sole judgment of the Remarketing Agent, will result in a sale of the Bonds at a price equal to the principal amount thereof on the Rate Determination Date. The Remarketing Agent shall make the Fixed Rate available by telephone or by Electronic Means after 5:00 p.m. on the Rate Determination Date to any Notice Party requesting such Fixed Rate. The Fixed Rate so established shall remain in effect until the Maturity Date of such Bonds.
FIXED RATES. The rates for service specified in this Agreement shall remain in effect for this Agreement and shall be determined in accordance with this Agreement for the Delivery Term, and shall not be subject to change for this Agreement through application to FERC pursuant to the provisions of Section 205 of the Federal Power Act absent the Agreement in writing of both of the Parties.
FIXED RATES. The rates and charges specified in Schedule 5.1, 5.2 and 5.3 shall be fixed for the duration of the CONTRACT subject only to adjustments for documented normal and customary changes in CONTRACTOR'S operating costs, including but not limited to, all personnel related costs, catering, insurance, repair and maintenance, travel expenses, and third party towing charges in the fixed price demobilisation fees. CONTRACTOR shall use reasonable efforts to keep the operating costs in line with industry practice.
FIXED RATES. Fixed rates will remain fixed for the applicable Term. This Agreement’s rates, charges and discounts are in lieu of any promotions or discounts that are available under Sprint’s Schedule or state Tariffs. Rates, charges and discounts for call types, Service elements, features, and Services not in this Agreement are in the applicable Sprint Schedule, state Tariff or public price list. Any percentage discounts will remain fixed for the Term, but Sprint may modify the underlying Schedule rate, Tariff rate or list price to which the discounts are applied; provided that such modifications would be general modifications applicable to Sprint’s general customer base, not modifications specific to Customer.
FIXED RATES. The rates for service specified in this Agreement shall remain in effect for this Agreement and shall be determined in accordance with this Agreement for the Delivery Term, and shall not be subject to change for his Agreement through application to FERC pursuant to the provisions of Section 205 of the Federal Power Act absent the Agreement in writing of both of the Parties.
