Expansion Commencement Date. After the execution and delivery of this First Amendment by all parties hereto, Landlord shall complete the Landlord’s Expansion Work at Landlord’s sole cost and expense and thereafter deliver possession of the Expansion Premises to the Tenant for the purpose of making the Expansion Improvements in accordance with the terms hereof. The Expansion Commencement Date shall be the date set forth in the definition of that term in Section 2 hereof. Tenant acknowledges that upon the substantial completion of Landlord’s Expansion Work the Expansion Premises shall be delivered AS IS and that no representations as to the condition of the Expansion Premises have been made by Landlord, provided that all base building systems shall be in good working order at the time of delivery of the Expansion Premises to Tenant. The taking of possession by Tenant shall establish that the Expansion Premises are in good and satisfactory condition when possession was so taken and the Expansion Commencement Date shall occur as provided in the definition of that term. In no event shall Tenant’s refusal or failure to take possession of the Expansion Premises delay or postpone the occurrence of the Expansion Commencement Date unless such refusal or failure is a result of Landlord’s failure to provide the Expansion Premises in good and satisfactory condition. Tenant’s possession of the Expansion Premises prior to the Expansion Commencement Date shall be solely for purposes of moving in furniture and equipment, preparing cabling and wiring and performing the Expansion Improvements as provided above and shall be subject to all of the terms and conditions of this Lease, except that Tenant shall not be required to pay Base Rent for the Expansion Premises with respect to the period of time prior to the Expansion Commencement Date during which Tenant performs such work. Tenant, however, shall be liable for payment of any above standard services (such as after hours HVAC service) that are provided to Tenant during the period of Tenant’s possession of the Expansion Premises prior to the Expansion Commencement Date).

Expansion Commencement Date. The Expansion Commencement Date shall be the date of this Amendment. Landlord shall deliver the Additional Premises to Tenant on the Expansion Commencement Date free of all tenants and occupants (including their personal property and trade fixtures), in broom clean condition, good working order and compliance in all material respects with applicable laws, codes, ordinances, rules and regulations.
Expansion Commencement Date. The later of (i) October 1, 2013 or (ii) Landlord’s delivery of the Expansion Premises to Tenant with Landlord’s Expansion Work substantially complete.
Expansion Commencement Date. Commencing as of December 15, 2012 (the “Expansion Rent Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant the Expansion Premises. Consequently, as of the Expansion Rent Commencement Date, the “Premises” as defined in the Lease shall be increased to include both the Existing Premises and the Expansion Premises. Expansion Commencement Date. Effective as of February 1, 2014 (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant the Expansion Space. Landlord and Tenant hereby stipulate and agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of square feet leased by Tenant in the Building to a total of 5,629 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” in the Lease shall mean and refer to the Existing Premises as expanded by the Expansion Space. Notwithstanding anything herein to the contrary, unless otherwise agreed to by the parties, should Landlord fail to deliver the Expansion Space, as improved by Landlord’s Work (as hereinafter defined), prior to March 7, 2014, the lease of the Expansion Space contemplated by this Third Amendment shall be null and void and any Monthly Basic Rent paid by Tenant for the Expansion Space shall be credited to Tenant and applied to the next installment of Monthly Basic Rent for the Existing Premises. Notwithstanding anything above to the contrary, such March 7, 2014 date shall be extended by one (1) day for each day of delay in Landlord’s substantial completion of Landlord’s Work, up to a maximum of an additional 120 days, due to delays caused by Tenant (including Tenant’s changes to the work depicted on Exhibit “B”), force majeure delays, governmental delays and other delays beyond Landlord’s reasonable control.
Expansion Commencement Date. Effective as of the date (“Expansion Commencement Date”) of Substantial Completion (as defined in the Work Letter Agreement attached hereto) of the Tenant Improvements in the Expansion Space (or the date Substantial Completion would have occurred but for Tenant Delays (as defined in Exhibit “B”)), Tenant shall lease from Landlord and Landlord shall lease to Tenant the Expansion Space. The Expansion Commencement Date is anticipated to be November 16, 2015. Effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Space. Landlord and Tenant hereby stipulate and agree that the addition of the Expansion Space to the Existing Premises shall increase the number of square feet leased by Tenant in the Project to a total of 29,935 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space.
Expansion Commencement Date. The term “Expansion Commencement Date” with respect to each portion of the Expansion Premises shall mean the date which is four (4) months after Landlord delivers possession of each portion of the Expansion Premises to Tenant. Effective as of each applicable Expansion Commencement Date, the defined termLeased Premises” under the Lease shall include the Original Office Premises and the applicable portion of the Expansion Premises. Additionally, effective as of the first Actual Delivery Date of any Expansion Premises within Building 8, the defined term “Buildings” under the Lease shall include Building 8.

Expansion Commencement Date. Effective as of the date the Expansion Space is Ready for Occupancy (as defined in the Tenant Work Letter attached hereto as Exhibit B) (“Expansion Commencement Date”), Tenant shall lease from Landlord and Landlord shall lease to Tenant, the Expansion Space. The anticipated Expansion Commencement Date is September 1, 2018. Upon the Expansion Commencement Date, the Existing Premises shall be deemed increased to include the Expansion Space. Landlord and Tenant hereby agree that such addition of the Expansion Space to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the number of rentable square feet leased by Tenant in the Building to a total of 52,148 rentable square feet. Effective as of the Expansion Commencement Date, all references to the “Premises” shall mean and refer to the Existing Premises as expanded by the Expansion Space. Effective as of the date hereof, Section 1.3 of the Original Lease is hereby deemed deleted in its entirety. Tenant’s early entry/early occupancy rights with respect to the Expansion Space are set forth in Section 5.1 of Exhibit B.
