Excess Deliveries. (i) If during any Settlement Interval Seller delivers Metered Amounts in excess of one hundred ten percent (110%) of the product of the Contract Capacity, expressed in MW, multiplied by the length of such Settlement Interval, expressed in hours, then the Product Price applicable to all such excess MWh in such Settlement Interval shall be Zero dollars ($0).

Excess Deliveries. When the actual quantity of Gas received at a Point(s) of Receipt, less Fuel and Loss, is less than the confirmed Delivery Nomination, the excess quantity of Gas, hereinafter referred to as “Excess Deliveries”, shall be sold by Gatherer and purchased by Shipper at one hundred and twenty percent (120%) of the highest daily price posted for Houston Ship Channel, as reported in Gas Daily, published by The MxXxxx-Xxxx Companies, during the Month in which the imbalance occurred, less the applicable location differential and transport fuel, plus Gatherer’s gathering and fuel rate(s). In the event Gas Daily ceases to be published or fails to report the necessary index price, Gatherer shall notify Shipper of the substitute index price to be used. EXHIBIT B TO TERMS AND CONDITIONS CURTAILMENT PROCEDURES Gatherer shall have the right to curtail all gathering service, in whole or in part on all or a portion of its System, at any time for reasons of Force Majeure incurred by Gatherer or Shipper’s Transporter, or when, in Gatherer’s reasonable judgment, capacity or operating conditions so require, or it is desirable or necessary to make modifications, repairs or operating changes to the System. Gatherer shall provide Shipper such notice of the curtailment as is reasonable under the circumstances. Gatherer will use reasonable efforts to identify and curtail only those Shippers whose Gas is nominated through the Point(s) of Receipt, or portion of the System, which are subject to curtailment. All curtailments will be made ratably for all affected Shippers, in accordance with each such Shipper’s confirmed nominations.
Excess Deliveries. Supplier shall not deliver any Products in excess of what is required by this Purchase Order without prior written consent from Flyer. If Supplier delivers any Product in excess of the quantity(ies) required by this Purchase Order, Flyer may, at Flyer’s option, accept and pay for such Product, but charge Supplier for any costs incurred by receiving the excess, or return such Products to Supplier at Supplier’s risk and expense.
Excess Deliveries. On any given Day during the Term of this Contract, Buyer may request and Seller may Tender for Delivery, a quantity of Product up to 120 % of the Daily Contract Quantity, provided however, it is at Seller’s sole discretion to make available to Buyer deliveries in excess of 100 % of the Daily Contract Quantity, if any.

Excess Deliveries. In the event that EPOS shall deliver any quantities of Fuel requested by PQPC in excess of PQPC's storage capacity and PQPC directs such quantity of Fuel be delivered to a third party designated by PQPC then PQPC shall reimburse EPOS for all reasonable expenses incurred by EPOS in connection with delivering such excess Fuel to a third party.

Excess Deliveries. If at any time Grantor delivers to Grantee PP Hydrocarbons in excess of the amount of PP Hydrocarbons required to be delivered to Grantee hereunder, the amount of such excess delivery shall not be returned by Grantee but shall instead be deemed an early delivery by Grantor of future PP Hydrocarbons and shall be considered as fully and finally delivered to Grantee for all purposes hereunder on the date received by Grantee; provided that if any Hydrocarbons are delivered hereunder to Grantee following the termination hereof the proceeds of such Hydrocarbons shall be paid to Grantor.
Excess Deliveries. (i) If during any Settlement Interval Seller delivers Metered Amounts, expressed in MWh, in excess of the product of the Contract Capacity, expressed in MW, multiplied by the length of such Settlement Interval, expressed in hours, then the Product Price applicable to all such excess MWh in such Settlement Interval shall be Zero dollars ($0) per MWh, and if there is a Negative LMP during such Settlement Interval, Seller shall pay to SCE an amount equal to the absolute value of the Negative LMP times such excess MWh (“Negative LMP Costs”).
Excess Deliveries. Goods must not be delivered by the Seller in excess of the quantity ordered The Buyer assumes no obligation to accept such goods and/or make payment in relation of such excess quantity delivered. The Seller must remove such expenses deliveries at their own risk and cost.
