Exactions. Owner shall pay or provide, as the case may be, all exactions, in-lieu fees or payments, dedication or reservation requirements, obligations for on-site or off-site improvements, construction requirements for public improvements, facilities, or services required of the Project or Property, whether such requirements constitute subdivision improvements, mitigation measures in connection with environmental review, or impositions made under any applicable ordinance or other applicable regulation.
Exactions. Except as otherwise provided in this Agreement, including, without limitation, Sections 8 and 9 hereof, Local Agency shall not impose any further or additional Development Fees or Exactions on the development of the Project, whether through the exercise of the police power, the taxing power, design review, conditions of approval or any other means other than (i) the County’s Non-Residential Affordable Housing Impact Fee (Napa County Zoning Code, Chapter 18.07 or such replacement provision in effect from time to time),
Exactions. Owner knows and understands its rights under Dolan v. City of Tigard and its progeny. By entering into this Agreement, Owner waives any requirement that the City demonstrate that the public improvements and other obligations imposed on Owner in this Agreement or the Xxxxxx’s Ranch Master Plan are roughly proportional to the burden and demands placed upon the urban facilities and services by the development of the Property. Owner acknowledges that the requirements and obligations of Owner, including but not limited to the required public improvements, are roughly proportional to the burden and demands on urban facilities and services that will result from development of the Property.

All exactions imposed upon the New Projects through conditions of approval, in lieu fees or payments, dedication or reservation requirements, obligations for on- or off-site improvements or construction requirements for public improvements or public facilities, or services called for in connection with the development of or construction on property under the Existing Ordinances, whether such exactions constitute subdivision improvements, mitigation measures, or impositions made under other Existing Ordinances or in order to make a project approval consistent with the City's laws or procedures.

Exactions. Exactions. District knows and understands its rights under Dolan v. City of Tigard and its progeny and by entering into this Agreement waives any requirement that the City demonstrate that the public improvements and other obligations of the District for the construction and financial responsibility set forth in Section 1 and related to the development of the Property with an elementary school are roughly proportional to the burden and demands placed upon the urban facilities and services by the development of the Property. This waiver notwithstanding, District acknowledges that the requirements and obligations of District, including but not limited to the required public improvements, are roughly proportional to the burden and demands on urban facilities and services that will result from development of the Property.
