Encumbrance Sample Clauses
An Encumbrance clause defines restrictions or claims on a property or asset that may affect its transfer or use. In practice, this clause requires the party transferring the asset to disclose any existing liens, mortgages, easements, or other third-party interests that could limit the recipient’s rights. By mandating such disclosure, the clause ensures transparency and protects the recipient from unexpected legal or financial obligations tied to the asset.
