Early Work. Early Work shall mean Construction Phase Services authorized by Amendment that the parties agree should be performed in advance of establishment of the GMP. Permissible Early Work shall be limited to: early procurement of materials and supplies; early release of bid or proposal packages for site development and related activities; and any other advance work related to critical components of the Project for which performance prior to establishment of the GMP will materially affect the critical path schedule of the Project.
Early Work. Design-Builder and Owner may enter into one or more Early Work Amendment identifying specific Work that shall be performed prior to a Pricing Amendment that includes such Work, subject to a not-to-exceed budget and price. All Early Work shall be performed and Owner shall pay for the same in accordance with the terms of the Contract Documents and the terms of the applicable Early Work Amendment. 6.3.1 Prior to commencing any Early Work: (i) Design Professional shall have issued Construction Documents for that Early Work; (ii) Governmental Approvals necessary to commence such Early Work shall have been issued; (iii) Design-Builder shall have submitted, for Owner Partiesreview and approval, a Construction Schedule and cost estimate for the Early Work; (iv) Design-Builder shall have selected Subcontractors to perform the Early Work; and (v) Owner Parties shall have issued a Notice to Proceed with the Early Work. 6.3.2 The costs of Early Work shall be included in the applicable Pricing Amendment and Design-Builder’s obligation to develop its Pricing Amendments shall not be deferred or waived by any Early Work Amendment.
Early Work. The CMGC may proceed with construction-related activities prior to the commencement of the Construction Phase only upon execution of an Early Work Amendment and receipt of the associated Notice to Proceed. Services provided by the CMGC in connection with any Early Work shall not be compensated as part of the Preconstruction Phase services, the eventual GMP, or any other existing cost category. Instead, the Parties must, as part of the Early Work Amendment, agree on a reasonable amount to compensate the CMGC for the portions of the Work that will fall within the scope of the Early Work Amendment. Any such amount will, unless otherwise agreed, be in addition to the costs negotiated under the GMP and all other cost categories under this Agreement.

Construction Manager shall be paid the Cost of the Work for all executed Early Work plus Construction Manager’s Fee for such Work. All Early Work shall be performed and Owner shall pay for the same in accordance with the terms of the Contract Documents and the terms of the applicable Early Work Amendment. Prior to commencing any Early Work: (i) Design Professional shall have issued Construction Drawings and Specifications for that Early Work; (ii) Governmental Approvals necessary to commence such Early Work shall have been issued; (iii) Construction Manager shall have submitted, for Owner Partiesreview and approval, a Construction Schedule and cost estimate for the Early Work; (iv) Construction Manager shall have selected Subcontractors to perform the Early Work in accordance with Section 6.4; and (v) Owner Parties shall have issued a Notice to Proceed with the Early Work. The Cost of the Work for all Early Work shall be included in the GMP of the applicable GMP Amendment and Construction Manager’s obligation to develop its GMP Amendments shall not be deferred or waived by any Early Work Amendment. Early Work. Seller hereby confirms his consent to Purchaser engaging in early construction work on the Property prior to Closing and exchange of the Warranty Deed. Purchaser will defend, indemnify and holder Seller harmless from any and all costs associated with such work or resultant from such work.

Owner does not, by execution of this Amendment, bind itself to specific rates for use in future Amendments, including hourly rates charged for CM/GC’s project management personnel or stated rental rates, but reserves the right for future negotiation of those rates.
Early Work. City may at any time require City to provide a proposal for performance of Early Work identified by City and may issue a Change Order or Directive Letter for performance of such Work, even though Construction Phase Approval has not yet been provided. In such case: (a) the Change Order or Directive Letter shall specify each such part of the Work that will be Early Work; (b) the relevant provisions of this Agreement will apply to all Early Work as if it were the only work included in the Work; (c) the Change Order or Directive Letter shall include an update to the Project Specific Information (Construction Phase) specifying Milestone Deadline(s), conditions to Completion, Completion Deadline, liquidated damages under Sections 12.5 and 17.8, Target Cost of the Work, Construction Phase Fixed General Conditions Cost, ▇▇▇▇ Firm’s Fee, ▇▇▇▇ Firm’s Contingency, insurance requirements provided in Exhibit 8B (Insurance Requirements – (d) the Change Order or Directive Letter may include such other terms and conditions as deemed appropriate by City.
Early Work. TDOT may consider early procurement of long-lead items or early construction work (e.g., and early work package) to complete initial Project tasks with the understanding that any early work is not a guarantee of selection for final construction. Early phases must be independent and severable from the final construction package, with a well-defined end point.
