EARLY TERMINATIONS. The Student may be released from this agreement for:
EARLY TERMINATIONS. Early terminations during the first year of service are subject to a $400.00 cancellation fee. Unless cancelled, service will renew for successive one (1) year service periods at the same terms and conditions contained herein. Notice of termination must be made in writing to GLOBAFONE Client Services, 0000 Xxxxxxxxx Xx Xxxxxxxxxx, XX 00000, XXX no less than thirty (30) days prior to the expiration of any term of this Agreement. This Service Agreement cannot be assigned without the written consent of GLOBAFONE. GLOBAFONE reserves the right to terminate this Contract at any time during the contract period for any reason.
EARLY TERMINATIONS. (a) If a Party is in Default, the non-defaulting Party may, in addition and without prejudice to any other remedies such non-defaulting Party may have under this Agreement or at law or in equity, suspend all performance under this Agreement or terminate this Agreement, in each case upon ten (10) Days’ prior written notice.
EARLY TERMINATIONS. If at any time Resident desires to terminate this Lease prior to the lease end date of the current term, Resident may do so upon not less than 60 days prior written notice to Owner (which notice shall state Resident’s date of vacating the Apartment). For such privilege, Resident shall pay to Owner (in addition to rent and other sums due Owner hereunder to the date of termination) a termination fee, accompanying Resident’s notice of termination and in an amount equal to twice the monthly rental. If Resident fails to vacate the Apartment on or before the date of vacating specified in Resident’s notice, or in the event Resident fails to strictly adhere to the provisions hereof, Owner may retain any termination fee paid as liquidated damages for Owner’s additional trouble and administrative expenses and, in addition to such other damages as Owner may be able to recover from Resident, Owner may elect not to accept termination of this Lease.
EARLY TERMINATIONS. In the event that SUMMER, or its activities hereunder, becomes subject to regulations of any kind whatsoever under any law, government body action or ERCOT action that has the effect of materially changing the circumstances from those that exist on the effective date of this Agreement then SUMMER may pass through the economic effects to Customer of such change or SUMMER may unilaterally terminate this Agreement without Customer’s consent upon at least thirty (30) calendar days written notice to Customer without any obligation, payment or otherwise, to Customer or an Early Termination Fee.
EARLY TERMINATIONS. Requests for contract releases that do not meet any of the above resignation conditions may be offered an early termination option with a penalty fee. Early terminations are available only if the RAYS have met the total number of swimmer projections for the season. Early terminations, if approved, will take effect at the end of the month in which the written request is received. Partial months are not prorated. The family will be responsible for all financial obligations until written early termination release is approved. All financial obligations must be paid in full to be released from a contract and any promotional discounts will have to be reimbursed. In addition to being responsible for all incurred expenses a penalty fee is assessed based on the total remaining contract value as indicated below: Nov 30, 2020 – 50% of total remaining contract value Dec 31, 2020 – 55% of total remaining contract value Jan 31, 2021 – 60% of total remaining contract value Feb 28, 2021 – 65% of total remaining contract value Mar 31, 2021 – 70% of total remaining contract value Early terminations are not available after April 1, 2021. Early terminations are at the RAYS Board discretion; therefore, early terminations may or may not be made available or approved. PHOTO RELEASE: Swimmers are sometimes photographed or videotaped while participating in RAYS activities. This is usually done by coaches or parents, but the local newspapers will occasionally take photographs as part of an article. Additionally, the RAYS, Xxxxxxxx Xxxxxxxx, and USA Swimming frequently take and incorporate photographs in their publications. Any photos provided to the RAYS become property of the RAYS. If you do not desire that your swimmer be photographed or videotaped during a team activity, please inform the RAYS Board Treasurer at xxxxxxxxx@xxxxxxxx.xxx.
EARLY TERMINATIONS. At any time during the Agreement Term, the Purchaser may give written notice of termination. If such notice is issued, this Agreement will terminate the next June 30 at least ten years but not more than eleven years from the date of the notice. Terminations prior to the end of the Agreement Term are considered Early Terminations and will require the Purchaser to pay Portland an Early Termination Fee as described in this Section.
EARLY TERMINATIONS. Section 22.1 If either Party fails to perform any of its obligations under this Agreement, the other Party may eliminate shipments or receipt of deliveries until such default is cured.
