Development Application. Any qualified applicant desiring to file a competing application must submit to the Commission, on or before the specified deadline date for the particular application, a competing development application, or a notice of intent to file such an application. Submission of a timely notice of intent allows an interested person to file the competing development application no later than 120 days after the specified deadline date for the particular application. Applications for preliminary permits will not be accepted in response to this notice.
Development Application. (a) At the time of making a Development Application with the consent authority under the Act, the Developer must submit with the Development Application: (i) the valuation report and Worksheet approved in accordance with clause 33.2; and (ii) a letter from the Community Housing Provider who is, or is proposed to be the party to the Contract for Sale, confirming that it has been consulted with respect to the design and location of the Affordable Housing Units and that the Community Housing Provider supports the lodgement of the Development Application. (b) The plans submitted with the Development Application must clearly identify the Affordable Housing Units and Car Park Lots that are to be subject to the Contract for Sale.

If the application for Development Consent is approved on terms different to the developer’s offer, the Planning Agreement cannot be entered into.
