Demos. The value for each Demo shall be calculated in accordance with the Triple Net Formula, except there shall be an additional credit in favor of the Purchaser in the amount of $0.25 per mile for each mile in excess of 250 miles recorded on such Demo’s odometer as of the Closing Date; PLUS
Demos. Subject to the Publisher Guide, Publisher may distribute Demo(s) digitally, either as a stand-alone or with other Demos, [***]. All rights, obligations, and approvals in this Agreement that apply to Software Titles will separately apply to any Demo. [***]
Demos. NI and its wholly-owned subsidiaries may activate a reasonable number of copies of the Add-Ons, at no charge, solely for sales and marketing purposes, including demonstrations of the Add-Ons functionality to potential customers (“Marketing Purposes”). The terms of this Agreement shall supersede and replace the terms of any license provided with the Add-Ons as they may apply to NI’s use of the Add-Ons for Marketing Purposes. Provider hereby grants NI and its wholly-owned subsidiaries an irrevocable (for the Term), world-wide, royalty-free right to install, use, perform and display the Add-Ons solely for the Marketing Purposes. Such license grant shall automatically terminate upon the termination of this Agreement.
Demos. Upon Rapiscan’s request, IMX shall promptly provide and deliver to Rapiscan five demonstration units of the QSTM Private Label Products per fiscal year. The purchase price for such demonstration units shall be at a [*] discount from the QSTM Products Standard List Price. Rapiscan shall certify that such demonstration units shall not be resold; in the event that a demonstration unit purchased by Rapiscan is resold, Rapiscan shall pay IMX the difference between the prices stated in this Section 3.09, and the price Rapiscan otherwise would have paid.
Demos. Imagistics agrees to review PBMS Equipment demo or trial units requests on a case by case basis.
Demos. All rights, obligations, and approvals in this Agreement that apply to Software Titles will separately apply to any Demo. No royalties will be payable to Microsoft for any Demo.
Demos. If Publisher wants to distribute a Demo it must obtain Microsoft’s approval as per the Publisher Guide. Subject to the Publisher Guide, Demo(s) may be distributed digitally or placed on a single disc, either as a stand-alone or with other Demos, and the suggested price of such units must be [***] or at a suggested retail price that does not exceed [***] or its equivalent in local currency. All rights, obligations, and approvals in this Agreement that apply to Software Titles will separately apply to any Demo. [***]
Demos. PBOS agrees to review PBMS Equipment demo or trial units requests on a case by case basis.
Demos. Publishers are no longer required to obtain Microsoft’s approval to distribute a Demo. Section 7.8 of the Xbox One PLA shall be deleted in its entirety and replaced with:
