Defined Terms and Interpretation. 1.1 In this Agreement, save where the context requires otherwise, the following words, terms and expressions shall have the following meanings: 1998 Act means the Data Protection Act 1998. 2000 Act means the Freedom of Information Act 2000. 2004 Regulations means the Environmental Information Regulations 2004.

Defined Terms and Interpretation. (a) The capitalized terms used herein which are defined in the Loan Agreement, shall have the respective meanings assigned to them in the Loan Agreement except as otherwise provided herein or unless the context otherwise requires.

A reference to any party shall include that party's successors or permitted assigns. A provision of law is a reference to that provision as amended or re-enacted.

In this Opinion Letter, Luxembourg legal concepts are expressed in English terms and not in their original French terms. The concepts concerned may not be identical to the concepts described by the same English terms as they exist under the laws of other jurisdictions. This Opinion Letter may therefore only be relied upon under the express condition that any issues of interpretation arising thereunder will be governed by Luxembourg law.
