CONSULTANT RESPONSIBILITY. The Consultant shall be responsible for the professional quality, technical accuracy, timely completion of drawings and other services rendered by the Consultant and its sub- consultants and shall, without additional compensation, promptly remedy and correct any errors, omissions, or other deficiencies, except to the extent that such errors, omissions or other deficiencies arise from the digital data created by Cheyenne/Laramie County Cooperative Geographic Information System (CLCCGIS). Upon notice to the Consultant and by mutual agreement between the parties, the Consultant will, without additional compensation, correct those services not meeting such a standard.

Consultant shall be responsible for the professional quality, technical accuracy, timely completion and coordination of all studies, reports and other Work rendered. Consultant is responsible for providing his or her own training and tools for performance of the Work. Without additional compensation, and without limiting the Board’s remedies, Consultant shall promptly remedy and correct any errors, omissions or other deficiencies in the Work. Consultant represents that all Work performed under this Agreement shall be performed in accordance with the standard of care of Consultant’s profession prevailing in Colorado.
CONSULTANT RESPONSIBILITY. By signing this Agreement, the Consultant pledges, under penalty of perjury, to comply with all applicable federal, state, and local laws in the performance of this Agreement, including but not limited to, laws regarding health and safety, labor and employment, wages and hours, and licensing laws which effect employees. The Consultant further agrees to provide written notice to the LADWP within 30 calendar days after being notified or acquiring knowledge of the following: 1) that any government agency has initiated an investigation which may result in a finding that the Consultant, or any of its subconsultants of any tier, is not in compliance with any applicable federal, state, and local laws in the performance of this Agreement; 2) all findings by a government agency or court of competent jurisdiction that the Consultant, or any of its subconsultants of any tier, has violated any applicable federal, state, and local laws. Further, by signing this Agreement, the Consultant pledges, under penalty of perjury, that the Consultant has not been found by a court of competent jurisdiction to have violated the California or Federal False Claims Act with an act of moral turpitude or committed a crime involving moral turpitude. The Consultant shall contractually obligate all Consultant subconsultants to comply with all applicable federal, state, and local laws in the performance of this Agreement and report any governmental agency investigations or violations of such applicable federal, state, and local laws or violations of the California or Federal False Claims Act to the LADWP, consistent with the provisions of this Section.
CONSULTANT RESPONSIBILITY. Consultant shall be fully responsible to The University for acts and omissions of its employees, subcontractors and others directly or indirectly furnishing services, labor, materials or equipment on its behalf.

Without additional compensation, and without limiting the Board’s remedies, the Consultant shall promptly remedy and correct any errors, omissions or other deficiencies in the Work not meeting that standard of care, including any breaches of the representations in this Agreement.
CONSULTANT RESPONSIBILITY. A responsible Consultant is a Consultant who has demonstrated the attribute of trustworthiness, as well as quality, fitness, capacity, and experience to satisfactorily perform the AGREEMENT. It is CEAC’s policy to conduct business only with responsible consultants.
