Construction Representative. In connection with the original construction of the Premises each party shall be bound by its Construction Representative set forth in paragraph 1 above. A party may designate a substitute Construction Representative by giving written notice to the other party.
Construction Representative. In connection with the original construction of the Lessee Improvements, each party shall be bound by the acts of its respective Construction Representative appointed by each party upon the execution of this Lease. Lessor’s Construction Representative is Xxxxxx X. Xxxxxxx or Xxxx Xxxxxxx and Lessees Construction Representative is Xxx Xxxxxxxxxx or Xxxxx Xxxxxxxxx. A party may designate a substitute Construction Representative by giving written notice to the other party. 11.
Construction Representative. The Bondowner may engage, in its sole discretion but at the cost and expense of the Borrower, a construction representative (the “Construction Representative”). As directed by the Bondowner, the Construction Representative shall review and approve the estimated construction costs for the Project and the Plans. In addition to its other responsibilities as set forth in Exhibit C, the Construction Representative may conduct periodic inspections of the Project and make periodic reports to the Bondowner with respect thereto, to ensure that all work performed on the Project has been performed in a good and workmanlike manner. The function of the Construction Representative shall be solely to assist the Bondowner, and neither the Bondowner, nor its agents or employees, shall be liable either directly or indirectly for any loss, claim or damage which may arise as a result of negligence, defective or inappropriate design, materials, workmanship or supervision. The Borrower hereby agrees to hold the Bondowner harmless and indemnified from any such loss, claim or damage.
Construction Representative. The Bondowner shall, at the Borrower’s cost and expense, retain an outside Construction Representative to perform the following services on behalf of the Bondowner:
Construction Representative. Lessor hereby appoints the following person as Lessor's representative ("Lessor's Construction Representative") to act for Lessor in all matters related to the construction of the Improvements and the related relocations: Xxxx Xxxxx. Lessee hereby appoints the following person as Lessee's construction representative ("Lessee's Construction Representative") to act for Lessee in all matters the construction of the Improvements (including, without limitation, approvals of the Lessee Improvement Preliminary Plans and Final Plans, change orders and cost estimate) and the related relocations: Xxxxxx Xxxxx. Notwithstanding the foregoing, with respect to approvals of the cost estimate, Lessee Improvement Preliminary Plans and Final Plans and change orders in excess of Ten Thousand Dollars ($10,000), Lessee's Construction Representative shall deliver, together with any approvals or proposed changes thereto, the written concurrence of Lessee's member of the Steering Committee. All communications with respect to the matters covered by this section are to be made to Lessor's Construction Representative or Lessee's Construction Representative, as the case may be, in writing in compliance with the notice provisions of the Lease. Either party may change its representative at any time by written notice to the other party in compliance with the notice provisions of this Lease. Lessor shall invite Lessee's Construction Representative to attend all of Lessor's regular project team meetings with respect to the construction of the Improvements.
Construction Representative. Both Landlord and Tenant shall appoint one individual as its “Construction Representative” who is authorized to act on its behalf in connection with any matters arising pursuant to this Section 3.2. The Construction Representative may be changed from time to time by notice hereunder from the then current Construction Representative to the other party’s Construction Representative or by notice from Landlord or Tenant pursuant to Section 10.1 of this Lease. Notwithstanding Section 10.1 of this Lease, any notices or other communication under this Section 3 may be made by letter or other writing sent by U.S. mail or email, provided the communication is made by one party’s Construction Representative to the other party’s Construction Representative.
Construction Representative. Landlord and Tenant each shall designate --------------------------- an individual as a "Construction Representative" who shall be responsible and authorized to give and receive all communications with respect to construction of Tenant's Fit-Up. Either party may change its Construction Representative by written notice to the other from time to time. Landlord's initial Construction Representative is Mr. Xxxx Xxxxxx . Tenant's initial Construction Representative is Xx. Xxxxxxx Xxxxxx.
Construction Representative. Lessee shall have the right to designate a representative of Lessee to participate in the planning, permitting and contracting for the construction of the Tenant Improvements. In the event Lessee designates such person, Lessor shall use reasonable and diligent efforts to include such person in all substantive planning, permitting and construction discussions, conferences and meetings and shall provide copies of all contracts for the work and submittals to the City prior to or concurrently with entering into such contracts or submitting plans to the City. Lessee acknowledges and agrees that such representative shall be involved for informational purposes only and shall not have any voting or approval rights with respect to any such planning, permitting or construction discussions, contracts or submittals.
Construction Representative. Each party authorizes the other to rely upon all approvals granted and other actions taken by the respective construction representative designated from time to time by such party, or any person hereafter expressly designated in writing in substitution or addition thereof by notice to the party relying thereon. Tenant hereby designates Xxxxx Xxxxxxx, email: xxxxxxxx@xxxxxxxx.xxx as its construction representative (“Tenant’s Construction Representative”) and Landlord hereby designates Xxx Xxxxxxx, email: xxxxxxxx@xxxxxxxxx.xxx as its construction representative (“Landlord’s Construction Representative”). Notices given under this Exhibit 2.1 shall comply with the terms and conditions of Section 16.9 of the Lease and simultaneously therewith, a copy of such notice shall be delivered to the applicable construction representatives by email at the addresses set forth above.
