COMPENSABLE DELAY. A Delay for which Contractor may be entitled under the Contract Documents to both an extension of the Contract Time and an adjustment of the Contract Sum for additional compensation.
COMPENSABLE DELAY. If the General Contractor is delayed at any time in the progress or performance of the Work by (i) acts or omissions of the Owner or Design Professional; (ii) major changes ordered by the Owner in the scope of Work; or (iii) any other cause which the Owner determines may justify the compensation of the General Contractor for the delay, the General Contractor’s compensation shall be equitably adjusted to cover the General Contractor’s actual and direct increased costs attributable to such delay.

If Contractor is entitled to an increase in the Contract Sum as a result of a Compensable Delay, determined pursuant to Articles 7 and 8 of the General Conditions, the Contract Sum will be increased by the sum of {$AMOUNT IN FIGURES} per day for each day for which such compensation is payable.

If the DB is delayed at any time in the progress or performance of the Work by (i) acts or omissions of the Owner; (ii) major changes ordered by the Owner in the scope of Work; or (iii) any other cause which the Owner determines may justify the compensation of the DB for the delay, the DB’s compensation may be equitably adjusted to cover the DB’s actual and direct increased costs attributable to such delay.

If Contractor is entitled to an increase in the Phase 2 Sum as a result of a Compensable Delay, determined pursuant to Articles 7 and 8 of the General Conditions, the Phase 2 Sum will be increased by the sum of $ per day for each day for which such compensation is payable (“Compensable Delay Daily Rate”). This Article 7 will only apply if the County exercises its option for Phase 2, and only to the extent that Contractor fulfills requisites proving entitlement to Compensable Delay damages.

COMPENSABLE DELAY. For purposes of this Agreement, compensable delays (“Compensable Delay”) shall include only the following events and only if they impact the critical path of the Specific Project: (1) material neglectful act or omission by Exelon; and (2) material change ordered in the Work not due to Contractor’s fault.
COMPENSABLE DELAY. 9.1. If Design Build Entity is entitled to an increase in the Total Contract Amount because of any Compensable Delay established pursuant to the General Conditions, the Total Contract Amount will be increased by the sum indicated below for each Day of Compensable Delay approved in a Change Order issued by the Judicial Council or accepted as Compensable Delay during the resolution of any Claim. This provision will apply only if the Judicial Council has issued a Notice to Proceed for the Post-GMP Phase Work and only to the extent that Design Build Entity establishes its entitlement to Compensable Delay pursuant to the Contract Documents. The Compensable Delay daily rate will be calculated by: (i) dividing the total cost of Design Build Entity’s General Conditions (staff and other costs per the Design Build Entity’s Price Proposal) on the Project by the total days in the Post- GMP Phase Time; and (ii) multiplying that daily rate by the number of days of Judicial Council approved Compensable Delay (e.g., Compensation for Compensable Delay = (Cost of Design Build Entity’s General Conditions / Post-GMP Phase Time) x Approved Days of Compensable Delay). Additional compensation for home office overhead and markup shall not be allowed. This formula shall not be adjusted during the performance of Work.

If the CM is delayed at any time in the progress or performance of the Work by (i) acts or omissions of the Owner or the Design Professional; (ii) major changes ordered by the Owner in the scope of Work; or (iii) any other cause which the Owner determines may justify the compensation of the CM for the delay, the CM’s compensation may be equitably adjusted to cover the CM’s actual and direct increased costs attributable to such delay.
COMPENSABLE DELAY. The term “Compensable Delay” means a delay that entitles Design Build Entity to an adjustment of the Total Contract Amount and an adjustment to the Contract Time pursuant to the Contract Documents, and excuses Design Build Entity from an assessment of Liquidated Damages for the specific delay period approved as Compensable Delay.
