Class Representative Service Payment. Class Counsel intends to request a Class Representative Service Payment for the Class Representative. Class Counsel may seek a service payment not to exceed $7,500. The Class Representative shall not be entitled to receive an Individual Settlement Payment.
Class Representative Service Payment. The Parties acknowledge that Plaintiff will apply to the Court for approval of the Class Representative Service Payment in the amount of $2,500 in recognition of her efforts and activities in furtherance of both the litigation and this Agreement. The Class Representative Service Payment shall be paid from the Cash Settlement Fund and will not be distributed to Plaintiff until after the Settlement Date. The Parties further agree that Elixir will not be obligated to pay any Class Representative Service Payment in excess of $2,500. If the Court approves the Agreement and the Class Representative Service Payment to Plaintiff, the Class Representative Service Payment approved by the Court will be paid by the Settlement Administrator within ten (10) calendar days after entry of the Final Order and Judgment. The Parties represent that their negotiation of, and agreement to, the compensation paid to Plaintiff did not occur until after the substantive terms of the Agreement had been negotiated and agreed. No interest shall be paid on the Class Representative Service Payment.
Class Representative Service Payment. Defendant agrees that Plaintiff may apply to the Court for a Class Representative Service Payment in an amount not to exceed $5,000.00. Plaintiff will file her request for approval of Class Representative Service Payment no later than fourteen (14) days before the hearing on the Motion for Final Approval. Defendant agrees not to oppose the motion for such service payment. The Settlement Administrator shall pay any approved Class Representative Service Payment no later than seven (7) days after the Effective Date.

Class Representative Service Payment. Subject to approval by the Court, Class Representative ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ will receive a Class Representative Service Payment in an amount not to exceed $15,000, for her services as Class Representative and in exchange for her executive a General Release of all claims against Defendants. This payment will be deducted from the Gross Settlement Amount.

Subject to Bankruptcy Court approval, a payment in the amount of $2,000 shall be made to the Class Representative, ▇▇▇▇ ▇▇▇▇▇▇▇, as a class services award (“Service Payment”), to be deducted from the Settlement Amount for her role as Class Representative in the Class Action. The Settlement Administrator (defined infra § 10) will issue an IRS Form 1099 to the Class Representative for the Service Payment, and the Class Representatives will be solely responsible for correctly characterizing the Service Payment for tax purposes and for paying any taxes on the amounts received.

Any Class Representative Service Payment would be in addition to the Class Representative’s 9 Individual Settlement Payment.
