Claim Experience. Notwithstanding the foregoing, the Parties shall take any action necessary to ensure that any claims experience under the UOL Welfare Plans attributable to FTD Participants shall be allocated to the FTD Welfare Plans.
Claim Experience. Notwithstanding the foregoing, SNI (acting directly or through its Subsidiaries or Affiliates) shall use its commercially reasonable best efforts to ensure that any claims experience under the EWS Welfare Plans attributable to SNI Participants is taken into account when determining premium rates for the SNI Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the Parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Myriad Welfare Plans attributable to MPI Participants shall be available to the MPI Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the Parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Duke Energy Welfare Plans attributable to Spectra Energy Participants shall be allocated to the Spectra Energy Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the Parties shall take any action necessary to ensure that any claims experience under the Holdings Welfare Plans attributable to New A&B Participants shall be allocated to the New A&B Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the Parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Bentley Welfare Plans attributable to CPEX Participants shall be available to the CPEX Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the Parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Temple-Inland Welfare Plans attributable to Guaranty Participants and Forestar Participants shall be available to the Guaranty Welfare Plans and Forestar Welfare Plans, respectively.
Claim Experience. The amount of claims made by customers and third ---------------- parties with respect to the Company's products or services in each of the past three (3) years has not exceeded .5% of the Company's net sales for each such year. For purposes of the foregoing, "the amount of claims made" refers to (a) the amount of the originally asserted claim, and (b) shall be limited to claims under theories of breach of contract, breach of warranty (express or implied), strict liability or product liability.
Claim Experience. Notwithstanding the foregoing, the Parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Duke Energy Welfare Plans attributable to GasCo Participants shall be allocated to the GasCo Welfare Plans.
Claim Experience. Notwithstanding the foregoing, the parties (acting directly or through their Affiliates) shall take any action necessary to ensure that any claims experience under the Quanex Welfare Plans attributable to Spinco Participants shall be allocated to the Spinco Welfare Plans.
