Ceiling Price. The Government will not be obligated to pay the Contractor any amount in excess of the ceiling price in the Schedule, and the Contractor shall not be obligated to continue performance if to do so would exceed the ceiling price set forth in the Schedule, unless and until the Contracting Officer notifies the Contractor in writing that the ceiling price has been increased and specifies in the notice a revised ceiling that shall constitute the ceiling price for performance under this contract. When and to the extent that the ceiling price set forth in the Schedule has been increased, any hours expended and material costs incurred by the Contractor in excess of the ceiling price before the increase shall be allowable to the same extent as if the hours expended and material costs had been incurred after the increase in the ceiling price.
Ceiling Price. The maximum amount PCCA will pay for the Work or phases of Work described in a Service Order.
Ceiling Price. Ceiling Price. The ceiling price for awarded BPA’s combined is $10,000,000.00 for the five year period.
Ceiling Price. The Contractor shall provide Ceiling Prices for all Heavy Equipment available for Rental under the Contract, and applicable Delivery Charges, for inclusion on the Contract Pricelist (see Section III.1.3
Ceiling Price. Total payments by the Company to the Seller for services performed hereunder, including authorized expenses, shall not exceed the Ceiling Price set forth on the face of the PO. Seller agrees to use their best efforts to perform the work required by this PO within the Ceiling Price, and shall notify the Project Coordinator when the expenses to date for labor and other authorized expenses are expected to exceed 85% of the Ceiling Price. Seller shall also identify this Ceiling Price and the cumulative amount invoiced to date on all invoices. The Company may, in its absolute discretion, refuse to increase the Ceiling Price and Seller shall not be paid any amounts in excess of the Ceiling Price.
Ceiling Price. (a) The ceiling price does not represent, nor shall it be construed as, a guarantee or minimum amount. The ceiling price for each Contract Line Item Number (CLIN) is provided in the summary table below. Ceiling Price. The cost plus fixed fee or ceiling amount for each delivery/task order will be the ceiling price stated therein and may not be increased except when authorized by a modification to the delivery/task order.
Ceiling Price. The Ceiling Price for the execution of the DBFM Agreement shall be indicated in the Tendering Instructions.
Ceiling Price. This subcontract is priced on a Time-and-Materials basis. The Ceiling Price for all work called for under this subcontract is Twenty Five Million US Dollars ($25,000,000.00). Payments will be made to SUBCONTRACTOR in accordance with the prices set forth in Exhibit “C” and with the payment provisions of this subcontract. The SUBCONTRACTOR waives its right to monies to which it might otherwise have been entitled for any amount expended in excess of the ceiling price.
