C below. The Awarding Authority shall retain five (5) percent of such estimated value as security for the completion of the Work and while the Contractor continues to carry on the Work, will pay to the Contractor the Approved balance, net of the five (5) percent, all previous payments, and all sums which may be otherwise retained under the provisions of this Contract.

C below. An Annual Suite may be used for any Qualified Authority Event so long as at least fifty percent (50%) of the fixed seats associated with such Suite are purchased by the Annual Suite licensee. The price for the Annual Suite tickets shall be determined by the Authority Event promoter, but in no event shall the price of such tickets cost more than the highest ticket price of all generally available lower bowl tickets (excluding VIP tickets, special access tickets, and other similar premium priced tickets, but not Club Seats). Subject to the provisions of Section 10.1(b)(ii), if the Annual Suite licensee does not purchase at least fifty percent (50%) of the fixed seats associated with its Suite, then the Suite in question shall be unoccupied and remain “dark” for the Authority Event in question.”
