Assignment Duration a. Contract Placement
Assignment Duration. It is the intent of the parties that the Assignment shall continue until the occurrence of a Divestiture. However, if no Divestiture shall have occurred on or before the second anniversary of the date hereof, or if a Divestiture does occur, but the Executive is not offered a Qualifying Position (as defined below), the Executive may request, by written notice to American delivered not later than 30 days after (and not earlier than 30 days before) the event (or the expected occurrence of the event) referenced in the immediately preceding sentence, that American negotiate with the Executive in good faith to find a suitable position for the Executive at American on mutually agreeable terms. If such an agreement is reached between American and the Executive, the Assignment will terminate and, notwithstanding anything else herein to the contrary, including but not limited to Section 4, neither party shall have any further rights or obligations under this Agreement.
Assignment Duration. A. The Association and the Department agree that opportunities for various assignments should be made available to Port Police Lieutenants. Reasonable time limits in an assignment increase the opportunity for Unit members to learn specialized skills and ensure a wider dissemination of knowledge, experience, and expertise throughout the Port Police Division. B. Port Police Lieutenant assignments are normally made for a minimum of three years. Temporary extensions may be granted on a case-by-case basis by the Port Warden II, who is the Chief of the Port Police Division within the Department. C. The establishment, duties, and staffing levels of special assignments are based on the needs of the Port Police Division and are at the discretion of the Port Warden II. D. The creation or reduction of assignment positions and length thereof are at the discretion of the Port Warden II. E. Regardless of time in a specialized assignment, an employee may be reassigned when: 1. An employee requests to be moved from the position; 2. An evaluation of the performance of the assigned employee is below acceptable standards and the employee fails to correct performance problems within a reasonable time period; 3. An employee commits an act of misconduct; 4. The position is no longer necessary as deemed by the Port Warden II or their designee and is eliminated; or, 5. The Port Warden II determines that positions must be rotated sooner based on the needs of the Port Police Division.

If an assignment is terminated, the obligations of the client towards ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ will become due immediately. d. An assignment will end ipso jure if and when ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ is no longer able to contract the IP because the model agreement between ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ and the IP has been terminated for whatever reason. In this event, no failure to meet its obligations towards the client may be attributed to ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇, and ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ will not accept liability for any damage suffered by the client as a result. The IP is entitled to set his/her own working times and hours within the specifications of the assignment and the requirements for proper performance of the assignment.

In this event, no failure to meet its obligations towards the client may be attributed to Manpower Business Professionals, and Manpower Business Professionals will not accept liability for any damage suffered by the client as a result. Assignment Duration. International Assignments are set at a maximum of three years, at which point the Assignee must repatriate or begin to localize in the Host Country. Localization includes the removal of assignment allowances and benefits. You will be assigned to the Host Company. You must abide by all laws in the Host Country and perform duties reasonably assigned to you by the Host Company. It is also expected that you will conduct yourself in a professional manner at all times and carry out your duties and responsibilities. While on Assignment, your status for Carrier International Trade Compliance (“ITC”) purposes shall be determined in accordance with the Carrier ITC Global Mobility procedures. This LOA does not create a contract of employment, but simply seeks to confirm the conditions which pertain to your International Assignment. The duration, terms and conditions of the Assignment are subject to revision in accordance with business needs, and changes to the Global Mobility Program or Company policies. Upon successful completion of your Assignment, the Company will relocate you back to your Home Country. Repatriation is contingent upon you independently obtaining and maintaining all applicable immigration authorizations, medical or other clearances required by Home Country. Carrier is under no obligation to facilitate your admission to Home Country. Repatriation or relocation to another global assignment location is provided if you have not been terminated for cause. The Company will make its best effort to identify an equivalent position for you within the Form of Letter of Assignment organization. However, the Company does not guarantee employment at the end of your assignment.
Assignment Duration. All other terms and conditions of this Contract remain in full force and effect.
