ARTICLE LEAVE GENERAL. When the employment of an employee who has been granted more vacation, sick leave or special leave with pay than he has earned is terminated due to death or lay-off, the employee shall be considered to have earned that amount of leave with pay granted to him. an employee is in receipt of an allowance and is on leave of absence with pay, the employee shall continue to receive that allowance. When an employee is on leave of absence without pay, the employee shall not be entitled to any pay, allowances or benefits during the period of leave of absence without pay.
ARTICLE LEAVE GENERAL. When an employee is in receipt of an extra allowance and is granted leave with pay, he is entitled during his period of leave to receive the allowance if the special or extra duties in respect of which he is paid the allowance were assigned to him on a continuing basis. For the purpose of leave or time off, operational requirements are deemed to exist when:
ARTICLE LEAVE GENERAL. For purposes of earned leave credits or other leave entitlements, a day shall be equal to seven decimal five (7.5) hours. When leave is granted, it will be granted on an hourly basis and the number of hours debited for each day of leave shall be equal to the number of hours of work scheduled for the employee for the day in question. Notwithstanding the above, Article Bereavement Leave, a day will mean a calendar day. When an employee has been permitted to liquidate more vacation or sick leave with pay than the employee has earned and the employee's employment is terminated by death, the employee shall be considered to have earned such leave. When an employee has been permitted to liquidate more vacation or sick leave with pay than the employee has earned, and the employee's employment is terminated by lay-off, the employee shall be considered to have earned such leave if at the time of lay-off the employee has completed two (2) or more years of continuous service. Following notice of lay-off, an employee entitled to liquidate earned leave only. The amount of leave with pay credited to an employee by the Council at the time when this Agreement becomes effective, or at the time when the employee becomes subject to this Agreement, shall be retained as leave by the employee, except as provided for in those clauses providing for the liquidation of compensatory leave. An employee is entitled once in each fiscal year to be informed, upon request, of the balance of vacation and sick leave. An employee is not entitled to leave with pay during periods the employee is on leave without pay or under suspension. Except where specifically provided in this Agreement, an employee shall not substitute one type of leave with pay for another type of leave with pay.
ARTICLE LEAVE GENERAL. During the month of May in each year, the Employer shall inform each employee of the balance of his sick leave credits and vacation leave credits as of the day of March. An employee may be granted leave of absence with or without pay as deemed appropriate by the Employer. Requests for a leave of absence should be made as far in advance as possible. If, at the end of the fiscal year, an employee's entitlement to vacation leave with pay includes a fractional entitlement, that of a day shall be carried forward to the following fiscal year. The Employer shall respond to any request for leave submitted by an employee as soon as possible after the request has been received.

When an employee is entitled to an allowance and is granted leave with pay, he is entitled during his period of leave with pay to continue to receive the allowance. During the month of May in each year the Employer shall inform each employee in the Bargaining Unit in writing of the balance of his special, sick and vacation leave credits as of the day of March. At the end of the fiscal year, an employee's entitlement to vacation leave with pay shall be recorded as actual days and a part day will be recorded as actual hours of entitlement. When the Employer rejects an employee's applicationfor leave, upon request the detailed reasons for the rejection shall be provided to the employee in writing. An employee shall provide three (3)weeks advance notice except in extenuating circumstances for leave of five (5) working days or more. An employee's request for any leave that the Employer has not responded to within ten (10)working days from the receipt of the application shall be considered as granted, unless for extenuating circumstances the Employer was unable to respond within the ten (10)working day time period. An employee who is on leave of absence without pay is not entitled to receive any pay or allowances for the period of leave without pay, unless this Agreement specifically provides otherwise. The Employer will respond to leave requests under this Article, in a timely fashion.
