Appointment and Scope. 2.1 The Company hereby appoints the VAR as its non-exclusive value-added reseller to market and resell the Products to Customers in the Territory on the terms of this Agreement. The Company may offer the VAR the right to participate in additional licensing programs, which may require the VAR to accept additional terms.
Appointment and Scope. Client hereby appoints U.S. Energy as its agent for managing Client’s energy supplies and to deal with third parties on behalf of Client, in connection with energy-related matters, in U.S. Energy’s capacity as Client’s agent, including, without limitation, the purchase of energy resources in such quantity and at such times as Client may authorize in writing, by electronic communications (e.g., by email), verbally or otherwise (“Energy Procurements”). U.S. Energy is authorized to contract on behalf of Client for the acquisition of energy supply, transportation and distribution. U.S. Energy hereby accepts such appointment and agrees to use commercially reasonable efforts to perform the services required by this Authorization.
Appointment and Scope. Customer appoints Gexa as its Retail Electric Provider (“REP”) for the ESI ID(s) served under this Agreement. Customer authorizes Gexa to: (i) act as Customer’s REP for all purposes; and (ii) provide the services required of a REP including, without limitation, the procurement, scheduling and delivery of electricity throughout the Term to each of the ESI ID(s) in accordance with the terms set forth in this Agreement, including the Terms and Conditions of Service set forth in Attachment A. Customer’s appointment imposes no other duties on Gexa other than those specified in this Agreement and the REP Services Agreement.

Appointment and Scope. Provided Distributor is in compliance with this Agreement, including without limitation, Distributor meeting the minimum purchase requirement obligations per year as mutually agreed to and set forth in Schedule D attached, DOBI Medical, subject to Section 3 a) below, hereby grants a limited, non-transferable (subject to Section 2 d) non-exclusive license to Distributor as DOBI Medical's authorized Distributor within the Territory with respect to the promotion, marketing, sales and servicing of those single use Product(s) that are specifically set forth in Schedule B, (and for no other products or services), for resale to its subdistributors, if any, and customer end users within the Territory.
Appointment and Scope. 1.1 This Agreement will be effective as of November 21,1997. The initial term will be for approximately three years ending December 31, 2000. Therefore, this Agreement will automatically renew for successive one-year periods unless terminated as provided in Section 11.
