APHIS. WS assumes no liability for any actions or activities conducted under this agreement except to the extent that recourse or remedies are provided by Congress under the Federal Tort Claims Act (28 U.S.C. 1346(b), 2401(b), and 2671-2680).

APHIS. The Animal and Plant Health Inspection Service, United States De- partment of Agriculture. Bark chips. Bark fragments broken or shredded from log or branch surfaces.
APHIS. WS has advised the Cooperator that other private sector service providers may be available to provide wildlife management services and notwithstanding these other options, Cooperator requests that APHIS-WS provide wildlife management services as stated under the terms of this Agreement.
APHIS. WS shall perform services set forth in the Work Plan, which is attached hereto and made a part hereof. The parties may mutually agree in writing, at any time during the term of this agreement, to amend, modify, add or delete services from the Work Plan.
APHIS. WS has statutory authority under the Acts of March 2, 1931, 46 Stat. 1468-69, 7 U.S.C. §§ 8351-8352, as amended, and December 22, 1987, Public Law No. 100-202, § 101(k), 101 Stat. 1329-331, 7 U.S.C. § 8353. , to cooperate with States, local jurisdictions, individuals, public and private agencies, organizations, and institutions while conducting a program of wildlife services involving mammal and bird species that are reservoirs for zoonotic diseases, or animal species that are injurious and/or a nuisance to, among other things, agriculture, horticulture, forestry, animal husbandry, wildlife, and human health and safety.
APHIS. In the facility compliance agreement, the facility operator must agree to comply with any additional requirements found necessary by APHIS to prevent the escape, prior to irradiation, of any pests of concern that may be associated with the arti- cles to be irradiated. In the importer compliance agreement, the importer must agree to comply with any addi- tional requirements found necessary by APHIS to ensure the shipment is not diverted to a destination other than an approved treatment facility and to pre- vent escape of plant pests from the ar- ticles to be irradiated during their transit from the port of first arrival to the irradiation facility in the United States.
APHIS. WS will provide periodic reports of activities and accomplishments at the request of the Cooperator.

APHIS. WS will use only APHIS-WS employees and APHIS Volunteer Program participants. All APHIS-WS employees and APHIS volunteers have successfully met APHIS firearm safety standards.
APHIS obligations shall be limited to and contingent upon the passage of an appropriation by Congress from which expenditures may legally be met.
APHIS. WS shall keep records and receipts of all reimbursable expenditures hereunder for a period of not less than three years from the date of completion of services provided under the Agreement and the Cooperator and its Auditor shall have the right to inspect and audit such records. Cooperator, including its Auditor may, upon reasonable notice, during regular business hours, examine all records of WS-CO relating to any project financed pursuant to the terms and conditions of the Agreement, for up to a period of three years after termination of this Agreement;
