Agency Authorization. The execution of this Agreement acts as a delegation to the Agency by each signatory of all the California Health and Safety code, Division 2.5 functions, and the Agency shall act as the Local EMS Agency as to each function.
Agency Authorization. This Agreement and any WVF Service Order (Service Order) authorizes WVF to act as agent for Customer as necessary, to provide the services described in the Service Order (Service), including but not limited to, ordering high speed internet, digital television, telecommunications and other services or facilities and increasing, adding to, terminating, decreasing, removing or rearranging such Service or facility on Customer’s behalf.

After the occurrence and during the continuance of any Event of Default (including the commencement and continuation of any proceeding under any Bankruptcy Law relating to any other Note Party), the Required Holders are authorized and empowered (but without any obligation to so do), in their discretion, to appoint an agent (the “Note Agent”) (i) in the name of each Guarantor, to collect and enforce, and to submit claims in respect of, Subordinated Obligations and to apply any amounts received thereon to the Guaranteed Obligations (including any and all Post Petition Interest), and (ii) to require each Guarantor (A) to collect and enforce, and to submit claims in respect of, Subordinated Obligations and (B) to pay any amounts received on such obligations to the Note Agent for application to the Guaranteed Obligations (including any and all Post Petition Interest).

OWNER hereby constitutes and appoints REAL ESTATE SOLUTIONS and its Agents full power and authority to do and perform all and every act and things necessary for the specific purpose of eviction and/or collection of unpaid rents in regard to the subject property as fully as OWNER might or could do if personally represented with full power of substitution and revocation, hereby ratifying and confirming all that said substitute (REAL ESTATE SOLUTIONS) shall lawfully do or cause to be done by virtue hereof. OWNER hereby grants MANAGER, REAL ESTATE SOLUTIONS the right to enter the property at any time MANAGER deems necessary.

(“U.S. Energy”) and Highwater Ethanol, LLC (“Client”) related to the provision of energy supply management services. Client and U.S. Energy agree on the following terms and conditions:

Each Producer who executes this document on behalf of itself and of its successors and assignees hereby appoint(s) and authorize(s) to act as its AA, for all purposes stated in the CPBA with respect to the gas to be delivered at the Receipt Point(s) specified in Attachment 2 of the CPBA. The powers and authority to act for the Producer delegated to the AA hereunder shall include without limitation:

Failure to comply with the foregoing shall subject VAR to termination.
